Re:   Application for a Development Permit for Prescribed Tidal Works
      U Drive Boat Hire
      Lot 158 on SP233178 located at 256 Gympie Terrace, Noosaville.


I refer to previous correspondence in regard to a roofed deck that has been
constructed on the above mentioned premises.

I act on behalf of Bayeno Pty Ltd which is the registered lessee for the subject
Marine Facility located at 256 Gympie Terrace Noosaville. On behalf of Bayeno Pty
Ltd I hereby apply for a Development Permit for Prescribed Tidal Works for the
subject deck area.

The brief summary of the relevant history of this application can be described as
follows. The subject property is located at 256 Gympie Terrace Noosaville. The site
is used for boat hire purposes in accordance with the terms of lease TL 0/208040
issued by the Department of Environment and Resource Management (DERM).

The Council has previously notified the applicant that that the deck had been
constructed without approval and further that applications for Prescribed Tidal
Works and Building Approval would be required in order to bring the structure into
compliance with the Noosa Plan.

An inspection of the deck revealed that it comprised a small ground level roofed area
containing approximately fifteen (15) square metres (please refer to the photographs
attached). It was also noted that part of the structure was located outside the lease
