PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 7 DECEMBER 2021

2 SITE DETAILS
2.1 Background
On 29 July 2020 an application was received to reconfigure the subject site from 1 lot into 12 lots.
As the application was made before 30 July 2020 it must be assessed under the Noosa Plan 2006.
The application was withdrawn on 15 February 2021.
On 7 October 2020 a request to accept an application to reconfigure the site (1 into 12 lots) under
the superseded planning scheme (Noosa Plan 2006) was received. On 30 November 2020 officers
agreed to assess the application under the superseded planning scheme given the high potential
for a successful compensation claim should the request be refused given the Noosa Plan 2020
does not support the creation of additional lots in Lake Weyba Drive south of Eenie Creek Road.
2.2 Site Description
The site is rectangular in shape located on the western side of Lake Weyba Road opposite Weyba
Creek. A detached house and sheds are located to the front half of the lot with the rear of the lot
slightly lower and generally vegetated. The rear section of the site is zoned Open Space
Conservation whilst the front half is zoned Detached Housing. The site is wholly affected by the
Flood Hazard Overlay whilst the Bushfire Overlay affects part of the site.
The following images detail the split zoning and the Biodiversity Overlay
