PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 8 SEPTEMBER 2020
ii. the format or presentation of the instrument;
iii. a spelling, grammatical or mapping error in the instrument that does not materially
affect the remainder of the instrument;
iv. a factual matter incorrectly stated in the instrument;
v. a redundant or outdated term in the instrument;
vi. inconsistent numbering of provisions in the instrument;
vii. cross-references in the instrument; or
b) the local government makes to—
i. reflect an amendment to the regulated requirements under the Planning Act and used
in the planning scheme; or
ii. amend a statement that a regional plan or the SPP is appropriately integrated, in whole
or in part, in the planning scheme, if the Minister has advised the local government that
the planning scheme appropriately integrates the regional plan or the SPP.
Part 1 of these guidelines sets out the process for an administrative amendment under section 20
of the Planning Act 201. The process for an Administrative Amendment is set out below:
Planning and preparation
1. The local government must prepare the proposed amendment.
Adoption
2. The local government must decide to adopt or not proceed with the proposed amendment.
3. If the local government decides to adopt the proposed amendment, the local government
must publish a public notice in accordance with the Act and the requirements prescribed in
Schedule 5.
4. The local government must, within 10 days of publishing a public notice, give the chief
executive:
a. a copy of the public notice; and
b. a certified copy of the administrative amendment, as adopted, including—
i. an electronic copy of the amendment or instrument; and
ii. a copy of any electronic planning scheme spatial data files (mapping) relevant to
the administrative amendment.
2. Noosa Plan 2020 - Administrative Amendment No. 1
Noosa Plan 2020 was endorsed by Council on 16 July 2020 and came into effect on 31 July 2020.
Since its implementation it has become apparent that there remain some unintentional errors that
require correction to ensure the efficient implementation of the scheme.
Of particular note is Part 5, Table 5.7.1 – Building Work, (Refer Attachment 1). The statement
“Class 10a structures” should be replaced with “Class 10 structures”. The consequence of including
the “a” is that any building works not associated with material change of use that is a class 10b
structure will require code assessment. Examples of Class 10b structures are a fence, mast,
antenna, retaining or free standing wall, swimming pool or the like. It was never Council’s intention
to require a code assessment for these building works, but rather they be accepted development
subject to requirements. The “a” is a typo and needs to be deleted as part of this amendment.
In addition to the above, Table 5.7.1 – Building Work needs to be amended to ensure consistency
in approach with a Ministerial condition relating to dwelling houses in residential zones.
