d. The Noise Management Plan referred to in Condition 83(b) shall be incorporated
in perpetuity in the By-Laws of the Body Corp for the whole development.
e. The Noise Management Plan shall include a process for dealing with complaints
and specify that the Restaurant/Café Management and Body Corp Manager be
responsible for dealing with any noise complaints.
B. Add Condition 97 as follows.
New Condition 97 – 18 June 2020
97. The Media room in Unit 1401 must remain unenclosed and is not to be utilised as a
bedroom.
C. Delete Condition 5 due to an administrative error in the previous minor change approval.
Finance & Risk
It is premature at this stage to provide advice on the likely prospects of the appeal. There will be
costs associated with defending the appeal, particularly if the matter proceeds to trial.
No mediation has been arranged currently for this appeal. However, the applicant’s acoustic
consultant and Council’s external acoustic consultant are currently reviewing the matter to
determine if there is an opportunity for the outdoor dining area to operate until midnight without
adversely impacting on residents’ amenity.
