SERVICES & ORGANISATION COMMITTEE MEETING AGENDA 11 OCTOBER 2016
Outcomes of 2016/17 delegations review
Required updates to current delegations and new delegation
LGAQ has generated one new delegation relating to the Body Corporate and Community
Management (Specified Two-lot Schemes Module) Regulation 2011, which has been identified
following consultation with the Manager of Planning and Environment as applicable to Council’s
operations. The relevant power is outlined in Table 1 below.

Body Corporate and Community Management (Specified Two-lot Schemes Module)
Regulation 2011 (Confirmed as required by Council’s Planning & Environment Manger)
Section 33(4) Power, as the relevant planning body, to issue a certificate certifying the
transaction has been approved or noted as required under the relevant Planning Act.
The above delegation relates to the sale of common property in a body corporate scheme and
requires a certificate from the local government. It is not expected to come up often but relates to
varying a community management scheme (CMS) which Council’s Planning and Environment
Branch currently sign off on where the assessment is limited to whether the CMS is consistent with
the development approval for the site.
The delegation review has identified a number of required amendments to the current Council to
CEO delegations relating to the following Acts:
Biosecurity Act 2014;
Building Act 1975
Building Regulation 2006;
Environmental Offsets Regulation 2014;
Environmental Protection Act 1994;
Environmental Protection Regulation 2008;
Heavy Vehicle (Mass, Dimension and Loading) National Regulation;
Heavy Vehicle National Law;
Local Government Regulation 2012;
Work Health and Safety Regulation 2011; and
Workers’ Compensation and Rehabilitation Regulation 2014.
A summary of the changes required to the delegations relating to the above Acts is outlined in
Table 2 below.
By having these delegations in place, official approval by Council is not required in the event that
the CEO or an appropriate on delegate is required to exercise the relevant power referred to in the
delegation.
Copies of the complete updated delegations and the new delegation relating to Body Corporate
and Community Management are provided for at Attachment 1.
