3. Background
+   On 27 January 2021, Council decided to approve an application involving Material Change of Use of
    Premises (Open Space Type 1 Sport & Recreation - Playground) over the Land (Council Reference:
    MCU20/0013).

    The playground is currently under construction and will be wholly contained on proposed Lot 31.

    Condition 15 of the approval requires that prior to commencement of the use of the playground, the site
    must be remediated and removed from the Environmental Management Register.

    Proposed Lot 31, which contains the playground, is being remediated in accordance with Condition 15
    a. of the approval. Once the proposed subdivision application is approved, Lot 31 can then be removed
    from the Environmental Management Register in accordance with Condition 15 c.

+   Three road closure applications are currently proposed over portions of Mary River Road and Maple
    Street to enable the playground infrastructure to be wholly contained on freehold lots.
