ORDINARY MEETING MINUTES 20 SEPTEMBER 2018
The following Recommendations from the Planning & Environment Committee were
adopted without discussion or further amendment.
Council Resolution
Moved: Cr Jackson
Seconded: Cr Stockwell
The Planning & Environment Committee recommendations dated 11 September 2018 be adopted
except where dealt with or held over by separate resolution.
Carried.
1 MCU18/0084 DEVELOPMENT APPLICATION FOR MATERIAL CHANGE OF USE FOR
VISITOR ACCOMMODATION TYPE 3 (RURAL CABINS) AT 340 POMONA KIN KIN
ROAD, PINBARREN
That Planning & Environment Committee Agenda Item 1 be referred to the General
Committee for further consideration.
2 MCU17/0005 DEVELOPMENT APPLICATION FOR MATERIAL CHANGE OF USE
ENTERTAINMENT AND DINING BUSINESS TYPE 2 RECREATION, AMUSEMENT &
FITNESS (PAINTBALL), 113 MARARA ST COOROY
That Council note the report by the Development Planner to the Planning & Environment
Committee Meeting dated 11 September 2018 regarding Application No. MCU17/0005 for a
Development Application for Material Change of Use of Premises – Entertainment and Dining
Business Type 2 – Recreation, Amusement & Fitness (Paintball) situated at 113 Marara St,
Cooroy and:
A. Refuse the application for the following reasons:
1. The proposed development is an inconsistent use in the Rural Zone and the
increase in traffic on Marara Street from the proposed development is not
contemplated by The Noosa Plan.
2. The proposed development is contrary to the Transport, Roads and Drainage
Code as the development will compromise the capacity and safety of Marara
Street.
3. The current condition of Marara Street is not capable of safely accommodating
any increase in traffic from the proposed development and a satisfactory solution
has not been identified to address the constrained sections of Marara Street
given the current road formation and environmental constraints.
4. A number of properly made submissions have been received raising valid
grounds of objection.
B. Advise the applicant that an indoor play centre does require a further development
approval to operate from the site and such a use would significantly impact on the
safety of Marara Street were such a use to commence.
3 MCU17/0046 PLANNING & ENVIRONMENT COURT APPEAL NO 2843 OF 2018
DEVELOPMENT PERMIT FOR MATERIAL CHANGE OF USE FOR DUPLEX DWELLING
AT 38 PARK CRESCENT, SUNSHINE BEACH
That Council note the report by the Manager Development Assessment to the Planning &

Environment Court Appeal No. 2843 of 2018 and agree to defend the appeal.
