6. Local Planning Framework
6.1 Planning Scheme
The Noosa Plan 2020 (planning scheme) is the key local planning instrument which sets out the intent for development within
the bounds of the Noosa Shire local government area (LGA).
6.2 Category of Assessment and Assessment Benchmarks
6.2.1 Summary
Table H below summarises the category of assessment for the proposed development and the relevant assessment benchmarks
of the planning scheme. As identified below, the development application will be subject to code assessment.

The following position has been adopted with respect to assessment against the Works Codes:
▪ The Driveway and Parking Code is considered to be generally not applicable to the proposed subdivision. With respect to
property access, this has been addressed in response to other codes. In addition the existing solid surface domestic
driveway over 474 McKinnon Drive provides appropriate access to the site. The proposed 10m wide easement burdening
proposed Lot 1 and benefitting proposed Lot 2 is sufficient for extension of the driveway to provide access to proposed Lot
2, and accommodate vehicle manoeuvring or passing if required.
▪ The Earthworks Code is not applicable as the proposed development does not involve earthworks.
▪ A response has been provided to the Existing Services Code.
▪ The Fire services for common private title code is not applicable as the proposed subdivision is in the Rural Residential
Zone which is not part of the Residential Zone category. Section 7.10 of the Bushfire Hazard Assessment and Management
Plan recommends the dwelling in the southern lot include dedicated fire-fighting water storage to protect from potential
bushfire hazard.
▪ The Landscaping Code is not applicable to the proposed development.
▪ The Sustainable Building Design Code is not applicable as the proposed development.
6.2.2 Zone
As shown in Figure 7 below, the site is located within the Rural Residential Zone. The immediate area is located within the Rural
Residential Zone, and the greater area located within either the Environmental Management and Conservation Zone or Rural
Zone.
The proposed development has been assessed against the provisions of the Rural Residential Zone Code. Pursuant to Section
6.8.4 (1) of the planning scheme, the purpose of the zone is to provide residential uses and activities on large lots, which are
compatible with the rural character of the area. The Proposed Development is considered to be consistent with the intent and
purpose of the Rural Residential Zone Code.
A full assessment of the Proposed Development against the provisions of the Rural Residential Zone Code is provided in the
attached Code Compliance Statements.
