PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 6 SEPTEMBER 2022

The applicant has not fully demonstrated compliance with the above codes. Whilst a dwelling can
potentially be sited outside the PMF on proposed lot 2 the applicant has failed to demonstrate
sufficient detail (levels and certification) that the waterway crossing section is suitable for the
intended use and achieves compliance with The Reconfiguring a Lot Code – Performance
Outcome PO13 and The Flood Hazard Overlay Code – Overall Outcome (2)e, Performance
Outcomes PO4, PO5 and PO7.
Despite requests for further information and meetings with the applicant Council has not been
supplied with sufficient detail to address concerns in regard to the impact of flooding on the access
to the rear house site (depth, velocity and duration).
Without this detail, we are unable to understand:
        how often the waterway floods;
        the duration of flooding in different storm events;
 the velocity of floodwaters and the rate at which the water rises; and
 the flood depth in comparison to the existing crossing.
Therefore, we are unsure whether the existing access way / crossing is sufficient in common rain
events to enable access for residents to exit/enter their property. Based on the site levels it is highly
likely this area will flood frequently and prevent access for future residents to their home. It is also
unclear the extent of works required within the riparian buffer to provide access across the
waterway but it could be extensive based on site levels.
Furthermore, without this detail no Risk Assessment or Disaster Management Plan can be
provided addressing the above outcomes or manage the risk for future residents
Biodiversity, Waterways and Wetlands Overlay Code
The following codes within the Noosa Planning Scheme are considered relevant to this application.
