Attention: Planning Department
Dear Planning Officer,
RE: MINOR CHANGE APPLICATION: MATERIAL CHANGE OF USE – DUAL OCCUPANCY
COUNCIL REF: MCU22/0158, OPW22/0228 & RAL22/0022
3 DELORME ST NOOSA HEADS QLD 4567 (LOT 148 RP 160425)
Please find attached an application for a Minor Change to vary the following elements of the approved drawings that
were endorsed by Council on 19/04/2023:
1. Internal alterations to both dwelling units to change each “Bike Storage” space to a Laundry Room; and
2. The rear unroofed Pergola area to both units changed to solid metal sheet roofing.
Amended plans are enclosed.
We believe that the proposal is justifiable for the following reasons:
(a) The change from Bike Storage to Laundry will have no impact on the external façade of the Dwelling units
and represents a very minor alteration to the Plot Ratio (it will increase from 39.29% to 42.44%). It is noted
however, that the Medium Density Residential Zone Code is silent on the maximum Plot Ratio for a Dual
Occupancy.
(b) The addition of the rear solid roofing will still allow more than 25m² of Private Open Space to each dwelling
unit (approx. 32m² is provided, excluding the swimming pools). Furthermore, the roof will be well away
from the rear boundary, with a 6m rear setback proposed. Site cover will be under 50% (it will be 46.9%).
We believe that the proposal meets the definition of ‘minor change’ to a development approval under Schedule 2 of
the Planning Act 2016 as follows:
This change is not and does not result in a different development;
The change would not cause prohibited development;
There is no referral agency required; and
There is no public notification required.
In addition, the proposed change is not considered a ‘substantially different development’ as outlined under the
‘Development Assessment Rules’ version 1.2, as follows:
The minor change does not result in a substantially different development;

Development is not resulting in a new use, new parcel of land, change in built form, impact on traffic or
increased impact on neighbours or infrastructure.
Given the above, we believe that there is sufficient justification for the proposed works to be able to be approved as
a minor change to the existing approval, and it is therefore requested that Council endorse the enclosed amended
plans as referenced documents.

you.
Yours Sincerely
