GENERAL COMMITTEE MEETING AGENDA 12 DECEMBER 2016
The application has been assessed against each of the above applicable codes. The pertinent
issues arising out of the assessment against the codes are discussed below:
Access
McKinnon Drive is a State Controlled Road and concerns were raised by Council and DTMR in
regard to access to the site. DTMR have provided conditions requiring some upgrading works to
McKinnon Drive and restricted access to an entry only (western driveway) and exit only (eastern
driveway). This will ensure safety for people and property entering and exiting the site. Refer to
Attachment 2.
Carparking
It has been determined the proposed 21 formal car spaces is adequate for the proposed daily
operations. Concern is raised as to the carparking for special events as the applicant foresees
approximately 100 patrons attending the site. The applicant suggests that overflow parking for
special events can be managed through off site parking and shuttle buses. A condition is
recommended that a traffic and car parking management plan for special events to ensure there
is no impact on surrounding properties and to maintain safety.
Protected vegetation
The trees located in the lots eastern portion are protected by the Biodiversity Overlay. The
proposal seeks to enhance this area and provide a koala/natural habitat area. This meets the
intent of the Biodiversity Overlay Code while providing a vegetation buffer between the adjoining
rural residential use. A scattering of trees exist along the boundaries outside the Overlay. A
condition is recommended to retain this vegetation and provide some additional vegetation to
ensure a buffer to the adjoining neighbour.
Bushfire
The lot is separated by McKinnon Drive to Tewantin National Park, the highest bushfire risk area.
The adjoining lots are lightly vegetated and there is good separation between the existing and
proposed structures to ensure safety of people and property.
Effluent disposal
The applicant has provided an effluent disposal report that demonstrates the new effluent
disposal system is sufficient for the uses proposed on a daily bases. Portaloos are proposed for
special events to supplement the on site disposal system.
Assessment of Applicant’s Grounds for Approval
Applicant’s ground
The Sunshine Butterflies provide a valuable and needed service to the community and the
development of the facility on the subject site will clearly benefit the community by supporting and
improving the lives of individuals with a disability and their families.
Assessment
Agree. The Noosa Social Strategy outlines there is a need for this type of social infrastructure.
The assessment is whether the subject site is the best location for the use being located in a
rural residential area. This is addressed in this report.
Applicant’s ground
It is considered an over-riding need exists for the development in the public interest; and the
social, economic and environmental benefits in developing the site for this community use justify
approving the proposed development. The application has considerable merit and sufficient
planning grounds exist to approve the application despite the conflict with the Planning Scheme.
