1.3. 10m landscape buffer to Holts Road
The original condition of the approval for the industrial estate required an increase in lot 4’s size
to allow a suitable building area and a 10m landscaped buffer to the Holts Road frontage. Lot 4 is
shown on the Plan of Development (POD) as Attachment 1. As part of the representations to the
condition of approval, the applicant at the time advised lot 4 would be dedicated as road reserve.
Lot 4 was therefore never increased in size but subsequently dedicated as road reserve. An
extract from Councils Senior Planning Officer representations report is provided below:
‘The applicant has since advised that they would prefer to enter into an agreement with
Council whereby on the cessation of the Boral Timber office, lot 4 be dedicated as road
reserve. The applicant has also advised that they would be prepared to ensure this area is
clear of any contaminants, buildings removed and that a strip be planted. The applicant has
advised further that Boral Timber are long term tenants and that this dedication may not
occur for some time. This approach is considered reasonable, as the proposed lot
dimensions are adequate for the need of Boral Timber and permits in the long term a buffer
to be achieved of the development to the Bruce Highway’.
Condition 11.5 of the approval required a 10 wide buffer to Holts Road. Condition 11.5 reads as
follows:
Condition 11.5
Lot 4 shall be amended to be a minimum of 40 metres wide in order to incorporate a future
10 metre landscape buffer to Holts Road. Alternatively Council may accept a legal
agreement that provides for the dedication of lot 4 as road reserve on the cessation of the
Boral Timber office. Where lot 4 is dedicated to Council, this land shall be free of any
contaminants, buildings/structures removed and a 10 metre wide buffer to Holts Road
planted in accordance with Council’s Policy on Landscaping Guidelines. All reasonable
costs associated with the legal agreement shall be reimbursed to Council.
The intent of the POD is for a 10m wide landscaped buffer to the full frontage of Holts Road to
screen development.
