Attention: Glen Conforti, Planning Technical Officer

Dear Glen

Peregian Beach Villas – Development Application Development Permit for Material Change
of Use of Premises - Visitor accommodation Type 4 and Multiple housing Type 4, 226 David
Low Way, Peregian Beach described as Lot 12 on SP 207105

Reference is made to the information request made 18 February 2014, about the abovementioned
development. Below is the response to each of the items that have been raised.
Planning
Issues 1, 2 & 3 - Site Cover, Gross Floor Area & Population Density
1. Please provide amended plans meeting the planning scheme requirements for site cover.
2. Provide amended plans demonstrating a reduced GFA for the site.
3. Provide amended plans demonstrating the units are 1 bedroom pursuant to the planning scheme
   interpretation of Population Density.

Please find attached revised architectural plans (refer Attachment 1A, 1B, 1C, 1D & 1E) for the
development that provide the following development parameters:
    •    Site Cover of 478m² being 39.8%;
    •    Gross Floor Area (GFA) of 527m²;
    • Maximum Population Density of 16 persons based on the revised floor layout.
The proposed development complies with the planning scheme with respect to site cover, being about
40%. The balconies for all units have been reduced in width by about 0.4m, which reduces the amount
of site cover overall on the site.
It is acknowledged that the proposed development exceeds the allowable GFA and population density
under the planning scheme. However, the proposed development is generally consistent with the scale
of the approved motel development over the land, having a GFA of 527m² and a population density of
16 persons.
A number of amendments have been made to the proposal plans including the alteration of the access
to the units at the ground floor and the size of the garages, which means that the GFA of the proposal
is now consistent with the GFA of the approved motel development, which is 528m². The entry area to
all of the units at ground floor have been modified as discussed, which has reduced the GFA and
provided a better design.
All of the units have a GFA of about 55m², excluding unit 4, which has a GFA of about 87m². This
includes unit 2, which previously had a greater amount of GFA because the entry was fully enclosed.

Further, changes have been made to the internal layout of the study and kitchen areas so that the
study areas cannot be considered a bedroom (refer to the floor plans – Attachment 1). Therefore,
the population density is also less than that allowed under the current motel approval, which is 18
persons.
Given the above, it is suggested that the scale of the proposed development is commensurate with that
of the current motel approval, which is a reasonable ground upon which the development relies.
Further, the proposed development will not be out of character and is well located with respect to
access to the Peregian Beach Village Centre.
Issue 4 - Landscaping, Stormwater Management and Bio-retention Bed
4. Please provide an amended plan indicating an alternate location for the bio-retention bed or an
   alternate water treatment solution.

With respect to this issue, please find attached and amended landscape plan sketch (refer Attachment
2A and Attachment 3) that shows the relocation of the bio-retention bed. The bio-retention bed has
been relocated further into the property and has an altered shape that allows for 1m of landscaping to
the frontage.
Additional landscaping has also been provided to the frontage of the visitor car parking bay and a
further 1m of landscaping is also proposed within the road reserve. The amount of landscaping now
proposed to the frontage will ensure that the streetscape is in keeping with the existing and desired
character of the locality.
A revised landscaping plan (refer Attachment 2B) is also provided that shows the block wall around
the Energex easement (refer Energex letter 14 March 2014). However, a revised landscape plan has
not been finalized at this time, which incorporates the sketch above (Attachment 2A), but will be
provided at the operational works stage.
Engineering
Issue 5 – Stormwater Connection
5. Provide a plan indicating the stormwater pit in the site’s frontage together with detail on how this
pit is connected to the Council drainage network. Should the stormwater pit in the site’s frontage
proves to be a viable connection point, provide an amended stormwater management plan.

Attached is a copy of the revised Stormwater Management Plan for the development (refer
Attachment 3). The revised plan shows the new location and sizing of the bio-retention basin as
discussed above. Further, the connection to the existing drainage infrastructure will be to the existing
stormwater manhole located in the road reserve, fronting the development.
Issue 6 – Vehicle Access
6. Provide plans that demonstrate that access to the proposed carspaces and garages can be
achieved. The vehicles must able be to enter the site and access the spaces in a forward gear,
reverse out and exit the site in a forward gear in a total of 3 movements. The plans must be:
       a) Prepared by a suitably qualified person to a suitable scale
       b) Prepared in accordance with AS/NZS2890.1:2004 with specific attention to section 5.4
           and figure 5.4
       c) Include specific garage door widths where necessary, and
       d) In regard to proposed Unit 4 it must be assumed that the adjacent visitor space is
           occupied.

7. Provide amended plans that provide the necessary queuing from David Low Way to the vehicular
control point as described in section 3.4 of AS/NZS2890.1:2004.

Please find attached a report from TTM Consulting (refer Attachment 4) that provides further advice
about on-site maneuvering for a standard vehicle and that the impact on the traffic flow on David Low
Way as a result of a vehicle queuing on the driveway will be negligible.

                                                                                            2|Page

With respect to the matter of access and maneuvering on site, Attachment 4 provides vehicle
templates for a standard vehicle gaining access to the garages and entering and leaving the site in a
forward direction.
The templates are shown on a revised site plan and also take into consideration widening of the garage
doorways, by 300mm. The width of the driveway between the units has also been increased by about
500mm. Further, since the templates were provided, the nib wall behind units 8 & 9 has also be removed
from the Site Plan (refer Attachment 1A). The information provided demonstrates that the proposed
development meets the requirements of AS2890.
With respect to the matter of queuing on the driveway, please note that there is space available on the
driveway for one (1) vehicle, which does not overhang onto David Low Way. The traffic engineer has
advised (Attachment 4) that the impact on the flow of traffic along David Low Way, should be minimal
given that the traffic generated will be low. Consequently, if queuing was to occur it would be for a
short period, being less than 10 seconds, which is considered acceptable.
General
It should be noted that in accordance with section 293 of the SPA, a formal response was provided to
Energex about the information request made. A letter of approval was received from Energex on 14
March 2014, subject to conditions. Further, a letter of approval was received from the Department of
Environment and Heritage Protection (DEHP) on 17 March 2014, with respect to the management of
unexploded ordinance (UXO), but no conditions were imposed.
In accordance with section 278 of the Sustainable Planning Act 2009 (SPA), this letter concludes the
response to the information request made and it is requested that the assessment manager proceed
with the assessment of the application. Accordingly, it would be appreciated if details of the adjoining
owners could be provided so that public notification can commence.
Should you have any questions with respect to the above, please do not hesitate to contact me direct.

Yours faithfully
