PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 11 JUNE 2019

# Site Description Image
5. Adjacent to State Heritage Listed Halse Lodge (northern
boundary), Peppers Report (eastern boundary) and
Detached and Attached Dwellings on the south western
     corners of the boundary.

6. Conditional access rights secured by an easement
agreement from Viewland Drive, through Peppers Resort to
two locations on the adjoining eastern boundary.

7. Benefited by:
 Easement L with an access way through the Viridan
Land to Viewland Drive and Morwong Drive (under
restricted vehicle types and hours); and
 Easement M and P which benefits the site by providing
rights for storage and use of garbage bins.

In each case the easements contain a provision which, in
effect, delays the rights granted under the easement until
such time as a development approval is granted for the
development of the dominant tenement. Once the
development is completed and in use, the access and bin
areas are available to the benefit of the site (i.e. Lot 27).

The easement rights do not extend to construction access.
