Dear Nadine,
Re: Response to Council’s Information Request
Development Permit for Material Change of Use to establish a Bar
Units 1-3/9 Rene Street, Noosaville
Lots 0, 1, 2 & 3 on BUP5337
Council ref: MCU22/0115
I refer to Council’s Information Request, dated 28 July 2022 in relation to the abovementioned development.
On behalf of the applicant, Weir Distilling Company Pty Ltd, and in accordance with Part 3(13) of the DA Rules
2017, we provide a response to all the issues raised. A response to the item(s) raised in Councils Information
Request is outlined below:
ITEMS 1 - 3:
The report details that up to 60 customers will be able to be seated at any given time and
that the premises will be operated to allow for restaurant style seated booking. Concerns
are raised with the maximum number of customers proposed and the use and scale of the
bar is not ancillary or subordinate to the distillery operations on site.
1. Provide a plan detailing the internal seating arrangement and waiting areas.
2. Provide further information (operational plan and internal layout plan) demonstrating
that no substantial queuing or waiting will be required to be provided external to the
building.
3. It is recommended that the application be modified to reduce the maximum number
permitted on site to 20 persons at any one time.
RESPONSE
Please refer to the revised Building Design Plans prepared by Collins Building Designs in Attachment 1. Drawing
A105 illustrates the proposed seating areas and queuing areas inside the building next to the building entrance,
as well as outside the building adjacent to the entry door. It is noted that the proposed maximum number of

patrons permitted on site at any one time has been reduced to only 40 persons. Providing capacity on the site
for a maximum of 40 persons will ensure that the Bar will remain ancillary to the to the distillery operations
currently operating on site, which occupies 169m2 of the tenancy.
ITEM 4:
The planning report and traffic report do not fully align with respect to the maximum
number of patrons that may utilise the site. The planning report details that up to 60 persons
may be accommodated whereas the traffic report details up to 20 persons. The planning
report also contends that there is an excess of motorcycle parking however the traffic report
has not demonstrated that these spaces are viable.
It is noted that the proposal is four (4) carparking spaces short with the report detailing that
the surrounding roads can accommodate the excess carparking.
Provide further clarification about carparking and the proposed numbers of patrons that will
utilise the site.
RESPONSE
Please refer to the revised Car Parking Assessment prepared by Rytenskild in Attachment 2, which details that
the site may accommodate up to 40 patrons onsite at any given time. The Car Parking Assessment justifies the
car parking allowance, based on the revised proposal for 40 patrons, on page 11 of Attachment 2.
ITEM 5:
Provide a plan that demonstrates the location of bicycle spaces on site.
RESPONSE
Please refer to the revised Building Design Plans prepared by Collins Building Designs in Attachment 1, which
includes the allocation of bicycle parking onsite. The proposal has allowed for four (4) bicycle parking spaces
onsite, with two (2) steel hoops provided.
ITEM 6:
The planning report and proposal plans indicate that the proposal does not comply with
current landscape requirements. It is suggested that additional dense planting along the
frontage of the site would assist in meeting the Performance outcomes.
Amend the landscape plan to provide reduced turf areas and larger landscape beds.
RESPONSE
Please refer to the revised Landscape Plans prepared by Lark Landscape Architecture in Attachment 3. The front
garden bed has been revised to include entirely deep planted landscapes, removing the turfed areas previously
proposed.

ITEM 7:
The proposed landscape planters, the proposed scooter parking and the building supports
appear to impact on the ability of vehicles to enter and exit the existing and proposed spaces.
Provide a plan with the swept paths of vehicles entering and exiting the existing and
proposed car spaces. The plans must be prepared by or endorsed by a suitably qualified
person (RPEQ) and include but not be limited to:
• dimensions of all spaces and aisles including the aisle width at the scooter spaces
opposite the roller door to the “industry” area
• swept paths for a B99 vehicle as described in AS/NZS2890.1:2004
• the swept paths must assume that the adjoining space is occupied
• sufficient detail to demonstrate that vehicles can enter the site and space in a
forward gear, manoeuvre on site and exit the site in a forward gear in a total of 3
movements.
RESPONSE
Please refer to the revised Car Parking Assessment prepared by Rytenskild in Attachment 2, which provides the
required vehicle turn paths on pages 13-18 for Council’s assessment. A written response to item 7 is also
provided on page 5 of Attachment 2.
ITEM 8:
Council has concerns with the width of the access driveway to the site and it’s capacity to cater for the
increase in traffic movements due to the proposed use. The access does not appear to provide
sufficient width for vehicles to pass and Council has concerns that vehicles entering the site will have
to stop or hold on Rene Street to allow a vehicle to exit the site.
Provide comment from a suitably qualified person (RPEQ) that addresses Council concerns and includes
recommendations for any necessary works (widening, signage etc).
RESPONSE
Please refer to the revised Car Parking Assessment prepared by Rytenskild in Attachment 2, which provides a
written response to the above item on pages 5 and 6.

Yours faithfully,
