   5 State Regulatory Provisions

The Planning Act 2016 prescribes the following categorising instruments as assessment benchmarks
   applicable to development applications:

         • the Planning Regulation 2017
         • the Planning Scheme for the local government area
         • any temporary local planning instrument; and
         • any variation approval.

The Planning Regulation 2017 (the Regulation) prescribes assessment benchmarks for code
assessable development applications. The following benchmarks are additional to the planning
scheme to the extent they are not appropriately reflected in the planning scheme:

         • the regional plan for a region, to the extent the regional plan is not identified in the planning
scheme as being appropriately integrated in the planning scheme; and
         • the State Planning Policy, part E, to the extent part E is not identified in the planning scheme
as being appropriately integrated in the planning scheme; and
         • any temporary State planning policy applying to the premises.

The relevant assessment benchmarks are discussed in detail below.

      • Safety and resilience to hazards;
      • Emissions and hazardous activities; and
      • Infrastructure.

Under part 2.1.1, the State interests not integrated or only partly integrated, include:

         areas.

The subject is not mapped within a coastal hazard or erosion prone area; therefore, no further
discussion is required with respect to the SPP. The existing church is not a State heritage listed place.

   5.3 Planning Regulation 2017

The State Assessment Referral Agency (SARA) is responsible for carrying out this function and
uses criteria from the State Development Assessment Provisions (SDAP). Schedule 10, Part 8,
Subdivision 2, Table 1 of the Planning Regulation 2017 confirms the assessment benchmarks
