7.0   Conclusion and Recommendations
       7.1 Statement of Planning Merit and Sufficient Grounds
             Pursuant to Section 326 of the Sustainable Planning Act 2009, any decision in relation to a development
             application must not conflict with a relevant instrument unless there are sufficient grounds as is detailed below:

             The assessment manager’s decision must not conflict with a relevant instrument unless—
               (a) the conflict is necessary to ensure the decision complies with a State planning regulatory provision; or
               (b) there are sufficient grounds to justify the decision, despite the conflict; or the conflict arises because of a
                    conflict between—
                    (i) 2 or more relevant instruments of the same type, and the decision best achieves the purposes of the
                           instruments; or
                    (ii) 2 or more aspects of any 1 relevant instrument, and the decision best achieves the purposes of the
                           instrument.

             Based on the detailed town planning assessment of the proposed development undertaken throughout this report
             it is concluded that there are sufficient grounds to warrant approval of the subject development application on the
             following grounds:

              ‐ The proposed expansion of the Tewantin Noosa RSL will improve the existing operations to the benefit of
                    the local economy;
              ‐ The proposed development is minor in scale and is unlikely to have any negative amenity impacts on
                    neighbouring properties or the surrounding locality;
              ‐ The proposed development is consistent with the outcomes and intent sought for the Tewantin – Doonan
                    Locality Plan and Community Services Zone; and
              ‐ The development does not result in any conflicts arising between State Planning Regulatory Provisions nor
                    any other relevant planning instrument as has been presented and discussed within this report.

       7.2   Recommendation
             Planit Consulting Pty Ltd has been engaged by Rubicon Design & Construct Pty Ltd to prepare a town planning
             report for a proposed Material Change of Use for an “Undefined Use” (Expansion to the existing Tewantin Noosa
             RSL) at their existing location on 5 Memorial Ave, Tewantin.

             This application has been prepared in accordance with the provisions of the Sustainable Planning Act 2009 and
             the relevant requirements of The Noosa Plan. An overall assessment of the proposed development against The
             Noosa Plan reveals the proposed development complies with the planning intent and character sought for the
             locality.

             This report demonstrates that the proposal will have no adverse amenity impacts, is compatible with surrounding
             development, and is in keeping with the future character of this locality as promoted by the Noosa Plan.

             Overall, it is considered that having regard to the relevant tests under the Sustainable Planning Act 2009 that the
             proposed development should be supported by Council and an approval issued subject to reasonable and relevant
             conditions in accordance with the IDAS development application process.
