Importantly, the proposed development does not result in changes to the dwelling located on Lot 1 on
SP269260, with the development remaining to be utilised as a dual occupancy.

4.2     Building Height

As illustrated within the Architectural Proposal Plans prepared by Shaun Lockyer Architects, the proposed
development provides for a compliant building height in accordance with AO10.2 of the Medium Density
Residential Zone Code of the Noosa Plan 2020. Compliance is further demonstrated within Figure 4 below.

4.3     Setbacks

As demonstrated in the Architectural Proposal Plans prepared by Shaun Lockyer Architects, the proposed
dwelling complies with the maximum building height provisions, presenting as a two‑storey structure and
remaining below 8 metres when measured from the natural ground line. The development therefore sits
comfortably within the intended built‑form envelope for the locality.

It is acknowledged that the proposed structure marginally encroaches into the prescribed boundary
setbacks, as illustrated in Figure 4. However, these encroachments are both minor and highly contained. The
portions of the dwelling that extend into the setback area are limited exclusively to non‑habitable elements,
including the stairwell and lift shaft, guttering and a single structural post supporting the upper level. These
components are modest in scale, do not accommodate habitable activities and do not give rise to any
unreasonable amenity impacts for adjoining properties.
