2 Emerald Planning Report
4.0 STATE PLANNING PROVISIONS This section sets out the statutory planning provisions applicable to the site and the proposed development. The overarching pieces of legislation applicable are the Planning Act 2016, Planning Regulation 2017, and the Noosa Plan 2020. The Planning Act 2016 provides the overall statutory planning framework for Queensland. The purpose of this Act is “to establish an efficient, effective, transparent, integrated, coordinated, and accountable system of land use planning, development assessment and related matters that facilitates the achievement of ecological sustainability”. The current Noosa Plan 2020 – Amendment 1 effective 25 September 2020 has been updated to align with the Planning Act and Planning Regulation. This Planning Scheme provides the planning and development assessment framework for current and future development of the site. 4.1 State Planning Policy (SPP) The Queensland Government released a single State Planning Policy (SPP) on 2nd December 2013. This instrument represents all matters of state interest to be considered in the preparation of development applications. The SPP includes assessment benchmarks that may be applicable where a local government planning scheme does not adequately reflect the SPP. The Planning Minister is satisfied that the current State Planning Policy (SPP) dated July 2017 is appropriately integrated in the Noosa Council's Planning Scheme with the exception of Natural Hazards, Risk and Resilience - Coastal Hazards (in part). 4.2 South East Queensland Regional Plan (SEQRP) The primary purpose of the South East Queensland Regional Plan 2009-2031 (SEQRP) is to provide a sustainable growth management strategy for the region that articulates strategic direction and certainty to accommodate a significant increase in population in SEQ to 2031. The Planning Minister has identified that the Noosa Council's Planning Scheme appropriately advances the South East Queensland Regional Plan 2017 as it applies to the planning scheme area. The subject site is mapped within the Urban Footprint under the Regional Plan. The Urban Footprint Intent: The Urban Footprint identifies land within which the region’s urban development needs to 2041 can be accommodated in a way consistent with the goals, elements and strategies of ShapingSEQ. Description: The Urban Footprint includes established urban areas, broad hectare and remnant broad hectare areas that could be suitable for future urban development. It incorporates the full range of urban uses, including housing, industry, business, infrastructure, community facilities and urban open space (SEQRP). Further to this Local Government planning schemes are the main instrument to which will refine the desired use of the land and the preferred timing of development within the Urban Footprint. The proposed development is considered consistent with the strategic intent for the land. 4.3 Local Government The Noosa Council Planning Scheme provides a single planning framework for the Cooroy region, streamlining local planning provisions and reducing assessment requirements. The new planning scheme supports growth and guides the way land, buildings and structures are used and developed in the Noosa Council area, enabling Council to plan for a sustainable future. The relevant provisions of the Noosa Council Planning Scheme to the proposed development are identified and addressed in Section 7 of this report.
