Planning Report
6. KEY PLANNING MATTERS
There are a number of key planning matters identified for the proposed development, including several
performance outcomes. These are discussed in detail in the following sections, along with justification for the
proposed responses to these matters. Key planning issues, such as consistency of proposed land uses,
economic and community need, building heights, site activation, bulk and scale, and visual and physical
connectivity are outlined in this section.
It is noted that the Noosaville Locality Code provisions are further refined through the Shire Business Centre
Zone provisions, which provides fine grain planning through probable solutions and specific outcomes.
Where similar matters of interest are identified (e.g. consistency of uses, height, setbacks, bulk and scale)
then these have been acknowledged.
A comprehensive assessment of the proposed development against the Primary, Secondary and Overlay
Assessment Benchmarks of the Planning Scheme is attached in Appendix C of this report.
6.1. CONSISTENCY OF LAND USES
As outlined previously, a site-specific approach to the definition of the land use for the development is
proposed by this application, through the identification of an Undefined Use – Noosa Marketplace. This
section therefore outcomes how the proposed Undefined Use response and respects the intent for the
pattern of land uses throughout the Shire Business Centre Zone and surrounding areas.
The western part of the site is included in Employment Precinct E5 (industry & Business), specific outcome
0148 of the Shire Business Zone Code states:
The nature, design and operation of any use in Precinct E4 and E5 is compatible and has strong
relationships with development in other precincts, in particular, Business Uses in Precinct B3
Whilst the north-east corner of the site is included in Business Precinct B3 (Showroom, Office & Business)
and includes specific outcomes 0117, 0118 & 0119 for the Shire Business Zone which respectively state:
Precinct B3 provides primarily for Retail business Type 4 Showroom and Commercial business Type
1 Office uses
Development within Precinct B3 comprises a gross floor area of—
a) For Retail business Type 4 Showroom—up to 7,000m2; and
b) For Commercial business—up to 11,000m2
Where development is staged, Commercial business Type 1 Offices and other non-Retail business
uses are developed as part of the first stage
These specific outcomes clearly speak to establishing compatible and strong relationships between precincts
E5 and B3, and the intent for employment generating activities to be a key focus from the outset of any
development.
Specific outcome 0146 also notes that precinct E5 includes an intent for industrial business type uses. The
planning scheme employs the nesting of land uses so that a primary use includes use classes and uses by
type. On review of the industrial types, it evident that some anticipated Type 2 Production, alteration,
repackaging & repairing and any Type 3 Extractive uses would likely be incompatible in the E5 precinct given
the B3 precinct intended land uses.
This is expressly recognised in Division 16, Section 11.7.2.(a) parts i, ii and iii of the Noosaville Locality Code
Overall Outcomes which state:
a) New uses and works are located, designed and managed to—
i. be compatible with other uses and works;
ii. maintain the safety of people and works;
