Note: Any tenancy/s may be used for one, or a combination of, the above uses where impacts and emissions
can be managed. For example, a Low Impact Industry tenancy used for a brewery may include a Hotel or
Bar use, or a Low Impact Industry making clothing may include a Shop use to enable the sale of clothing
from the same tenancy.
The key reasons for adopting the Undefined Use approach include:

•   The use definitions more appropriately describe the development;

• If a group of planning scheme defined uses / use types was applied for, it could result in uses operating
in an inappropriate or inconsistent manner, having regard to the planning scheme intent of the site; and

• Allows flexibility of land-uses needed to promote the success of the marketplace concept.

It is noted that this approach was ultimately successful in the Masters approval, and considered fit-for-
purpose when the site is considered as a whole, and within the Shire Business Centre setting. We consider it
delivers the key land use intents and represents orderly development where individual and cumulative
tenancy impacts can be effectively managed through existing assessment benchmarks or can be managed
through reasonable and relevant conditions of approval.

6.2. RETAIL CAP
Specific outcome 0118 of the Shire Business Centre Zone includes a retail cap on Type 4 Showroom uses of
7,000m2 GFA. As detailed in the Location IQ report, the existing footprint of development in the Noosa
Emporium development and within Noosa Civic (located directly east of the site) appears to allow for limited
additional GFA, and we note that all tenancies are currently occupied.
However, on closer review, we note Council’s support for the following tenancies in Noosa emporium:

• Cash Converters – Retail Business Type 2 Shop & salon

• F45 – Entertainment and dining Type 2 Recreation, amusement & fitness
As shown in the series of shop front images these are distinct tenancies.
