Attention: Cody Johnston
Dear Mr Johnston
SARA Pre-lodgement advice – Claude Batten Dr, Noosa
Heads
I refer to the pre-lodgement meeting held on 6 October 2023 in which you sought advice from the State
Assessment and Referral Agency (SARA) regarding the proposed development at the above address.
This notice provides advice on aspects of the proposal that are of relevance to SARA.
SARA’s understanding of the project
The applicant has a development approval and environmental authority to undertake dredging works to
mitigation erosion at the Noosa Spit (Dog Beach). The current approval only permits dredging works to
be undertaken during April to September. The applicant has not been able to complete the works within
this window and is concerned that the continued erosion of Noosa Spit (Dog Beach) may result in a
break-through of this area. The applicant is considering options to prevent this break-through from
occurring.

Pre-lodgement advice
The following advice outlines the aspects of the proposal that are of relevance to SARA.
SARA’s jurisdiction and fees
1. The proposal will require a change application to the development approval to be lodged
with SARA. SARA will be a responsible entity under section 78A of the Planning Act 2016
for the proposed change as the change relates to conditions of the SARA referral agency
response dated 28 February 2023 (2212-32529 SRA).
As discussed in the pre-lodgement meeting on 6 October 2023, the change is likely to be
considered ‘minor’. The fee for a change application for a minor change to a development is
outlined in schedule 15 of the Planning Regulation 2017 and would be 1,714 fee units
which is $1,817 for the 2023/24 financial year.
Change to the existing approval
2. It is understood that increased erosion at the site has resulted in some trees (casuarinas)
falling into the pre-determined works footprint. Whilst the works being undertaken may not
increase the impact footprint beyond what was approved, the impact area to marine plants
may increase as a result of these trees being within the works footprint. The additional area
resulting from these fallen trees would be considered a minor change and need to be
quantified.
3. In a pre-lodgement meeting of 6 October 2023, it was indicated that additional dredging
channels may be required to reach project design desired objectives. Works would be
considered a minor change of the original approval if these dredging channels do not:
result in additional impact area to marine plants
occur outside the footprint of the original approved works footprint
encroach within the 100m setback buffer to the adjacent Fish Habitat Area
If works result in any of the previous additional impacts, works may be considered an other
change to the original approval.
4. Under condition 14 of the development approval, works must only be conducted between
April and September. It is considered reasonable to change the time constraints on works
under a minor change application to hasten completion of works, provided that the footprint

of marine plant disturbance does not increase, with the exception of trees that have fallen
from the eroding foreshore within the approved beach nourishment footprint.
Works associated from erosion control measures
5. In the pre-lodgement meeting of 6 October 2023, it was noted that if erosion continues to
occur at Noosa Dog Park Beach the applicant may seek to undertake alternative erosion
control measures to prevent a break-through in this area.
It is not possible to provide accurate advice surrounding any erosion mitigation measures
as designs and plans have not been submitted. Therefore, it is not possible to indicate
whether proposed erosion control works would trigger marine plant disturbance, nor
whether proposed erosion control works would constitute a minor change to the original
approval, or an other change.
Environmental authority
6. The proposed works also relate to the conditions of the Environmental authority P-EA-
100375359 issued by the Department of Environment and Science on 10 February 2023. It
is noted the applicant has previously held discussions with the Department of Environment
and Science regarding this issue. Further information on changing or amending an
environmental authority is available at: https://www.business.qld.gov.au/running-
business/environment/licences-permits/change-combine/change
Lodgement material
7. It is recommended that the following information is submitted when lodging the change
application to SARA:
change application form (Planning Act Form 5)
relevant documentation identifying the change and reasons for the change
an assessment of whether the change is minor, considering the definition in schedule 2
of the Planning Act 2016
information on the extent of additional impact on marine plants (if any) as noted in items
2-4 above
landowner’s consent, if required for the application.
This advice outlines aspects of the proposed development that are relevant to SARA’s jurisdiction.
This advice is provided in good faith and is:
based on the material and information provided to SARA
current at the time of issue
not applicable if the proposal is changed from that which formed the basis of this advice.
The advice in this letter does not constitute an approval or an endorsement that SARA supports the
development proposal. Additional information may be required to allow SARA to properly assess the
development proposal after a formal application has been lodged.
