Pre-lodgement advice
The following advice outlines the aspects of the proposal that are of relevance to SARA.
SARA’s jurisdiction and fees
1. The proposal will require a change application to the development approval to be lodged
with SARA. SARA will be a responsible entity under section 78A of the Planning Act 2016
for the proposed change as the change relates to conditions of the SARA referral agency
response dated 28 February 2023 (2212-32529 SRA).
As discussed in the pre-lodgement meeting on 6 October 2023, the change is likely to be
considered ‘minor’. The fee for a change application for a minor change to a development is
outlined in schedule 15 of the Planning Regulation 2017 and would be 1,714 fee units
which is $1,817 for the 2023/24 financial year.
Change to the existing approval
2. It is understood that increased erosion at the site has resulted in some trees (casuarinas)
falling into the pre-determined works footprint. Whilst the works being undertaken may not
increase the impact footprint beyond what was approved, the impact area to marine plants
may increase as a result of these trees being within the works footprint. The additional area
resulting from these fallen trees would be considered a minor change and need to be
quantified.
3. In a pre-lodgement meeting of 6 October 2023, it was indicated that additional dredging
channels may be required to reach project design desired objectives. Works would be
considered a minor change of the original approval if these dredging channels do not:
result in additional impact area to marine plants
occur outside the footprint of the original approved works footprint
encroach within the 100m setback buffer to the adjacent Fish Habitat Area
If works result in any of the previous additional impacts, works may be considered an other
change to the original approval.
4. Under condition 14 of the development approval, works must only be conducted between
April and September. It is considered reasonable to change the time constraints on works
under a minor change application to hasten completion of works, provided that the footprint
