Response from DEHP would be required.

Notes for completing this form
Question 8:
Section 263 of the Sustainable Planning Act 2009 sets out when the consent of the owner of the land is required
for an application. Section 260(1 )(e) of the Sustainable Planning Act 2009 provides that if the owner’s consent is
required under section 263, then an application must contain, or be accompanied by, the written consent of the
owner, or include a declaration by the applicant that the owner has given written consent to the making of the
application.
Owner’s consent is not required for a mobile and temporary ERA.
Question 9:
Section 264 of the Sustainable Planning Act 2009 provides that if a development involves a state resource, a
regulation may require the application to be supported by certain evidence prescribed under the regulation.
Schedule 14 of the Sustainable Planning Regulation 2009 prescribes the state resources for which evidence is
required to be given, and the evidence required, to support the application.
Question 13:
The Building and Construction Industry (Portable Long Service Leave) Act 1991 prescribes when the portable
long service leave levy is payable.
The portable long service leave levy amount and other prescribed percentages and rates for calculating the levy
are prescribed in the Building and Construction Industry (Portable Long Service Leave) Regulation 2002.
Question 14:
The portable long service leave levy need not be paid when the application is made, but the Building and
Construction Industry (Portable Long Service Leave) Act 1991 requires the levy to be paid before a development
permit is issued.

Thank you for your letter 20 November 2012about your proposal to construct a pontoon at
the location mentioned above.
As a concurrence agency, Maritime Safety Queensland has no objection to the proposal
provided the following navigation and marine safety conditions are complied with.
1. The contractor must build the pontoon according to The Marina Specialist, Drawing No:
JSP-SJ-25520, Issue A, attached to your letter dated 20 November 2012.
2. No part of the structure or any ship berthed at this structure is to come closer than 1.5
metres from the side boundaries of the allocated water space as shown on the
submitted water allocation plan.
3. In, the absence of a designated quayline, the structure and any part thereof must not
extend beyond that of neighbouring approved structures.
4. The pontoon/jetty and all freestanding piles must be lit and clearly visible to approaching
vessels. The contractor must position all lighting so it does not cause a risk to the safe
navigation of other vessels.
5. The applicant or his agent is responsible for the removal of any existing structure above
or below the waterline, and must contain and remove any debris. Any pile that needs to
be removed must be totally extracted.

6. The ship moored at this pontoon must follow the most direct course from this structure
to open waters and a similar direct course when returning to this pontoon.
7. The owner is to ensure that the ship berthed at this structure must maintain sufficient
under keel clearance at all stages of tide. The ship must comply with
any local
restrictions placed on channel depths and draft restrictions.
8. Any ships and equipment you or your agent use must comply with the Transport
Operations (Marine Safety) Act 1994, the Transport Operations (Marine Safety)
Regulation 2004 and the Transport Operations (Marine Pollution) Act 1995.
9. Any ships using this structure must comply with’the Transport Operations (Marine
Safety) Act 1994 and the Transport Operations (Marine Safety) Regulation 2004.
10. Any ship moored at this pontoon must not impede the safe navigation of other ships or
restrict safe access to or from neighbouring structures.
11. Any ship berthed, moored or attached to the pontoon must not exceed the following
sizes:

12. The contractor must construct the pontoon within two years from the date of approval. If
construction is not completed, you will need additional or amended comments from the
Regional Harbour Master.
Maritime Safety Queensland does not need to be further consulted if all of the above

This agency will also forward a copy of this letter to the Assessment Manager.

This design advice does not cover the construction or installation of the works on site. The Builder shall
confirm the adequacy of the site conditions during installation and shall advise the Engineer if variation
from details shown on the drawings occur. No detailed site investigation or studies have been carried
out by us or provided to us. The design review has been carried out on the basis of limited enquiry only.
Pile depths shown are applicable to founding in stiff clay or dense sand. There is some additional risk of
failure should the above design criteria be exceeded, or actual site conditions be inferior to those
assumed. If ground conditions other than those described above are encountered during construction
or seabed levels encountered are deeper than those shown on the drawings, further advice should be
sought.
This design advice relies on designs prepared by other consultants, but does not warrant them.
