  Noosa Shire Council
  PO Box 141
  Tewantin QLD 4565

  Dear Sir/Madam

  Request for GIA assessment against 51993.1086 (TPC2622 – 06/12/1993) for a
new swimming pool, suspended tiled terrace and boundary fencing that do not
comply with the setback acceptable outcomes of the Medium Density
  Residential Zone Code.

  Lot 1 on GTP102061 – 1/35 Viewland Dr, Noosa Heads QLD 4567

On behalf of our client, we request that Council consider the proposed building works
as GIA against 51993.1086 (TPC 2622 DUPLEX DWELLING).

The intention of the proposed building works is to match the pool and fencing
configuration of the adjoining unit (2/35 Viewland Dr) that was GIA approved under
51993.1086.01 submitted on the 17/09/2014. Please see the below picture of the back
of the pool on the adjoining property taken from the Environmental Management and
Conservation zoned land behind the subject site.

Please refer to the enclosed Tim Ditchfield Architects Plans Ref: 2104 dated Nov 2021
and the below area of non-compliance.

   AO12.1 – Setbacks
o The pool is approx. 1.140m above NGL and therefore does not comply with
the required 6m setback to rear boundaries. It is noted that the affected
property to the rear is zoned Environmental Management and Conservation.

o The proposed eastern side boundary fencing exceeds 2.0m when measured
from NGL (~3.6m proposed – new block wall and planter with rendered light
weight wall over the sewer). It is noted that the fencing height measured from
the suspended tiled terrace totals 2.5m

o The proposed western side boundary fencing exceeds 2.0m (2.6m inc trellis)
however this fence is not being altered as part of these works. This boundary
fence adjoins the private access road described as lot 0 on SP190823

o The 1.2 frameless glass balustrade on the western edge of the suspended
slab and on the northern boundary exceeds 2.0m when measured from
           natural ground (2.4m proposed)

o Construction of new stairs to tiled terrace located 0.8m from the western side
boundary in lieu of 1.5m for structures above 1m in height.

   AO10/11 – Site Cover/Plot Ratio
o The proposed works are more than 1m above ground and therefore
constitute site cover and exceed the permitted 40% site cover and/or 0.4:1
           plot ratio

By way of justification for the above areas of non-compliance, PO12 of the Medium
Density Residential Zone Code is addressed below:

      a) The proposed works increases amenity levels for the subject site and are
consistent with the already completed works at the adjoining property, therefore
amenity levels of the adjoining property will not be adversely affected.
      b) The proposed works will not increase instances of overlooking or obstruct any
         views.
      c) The site adjoins a non-residential zoned land to the rear which ensures sufficient
         separation from adjoining land uses.
      d) The proposed works include the removal of vegetation within private property
only. No works are proposed in the Environmental zoned land to the rear.
      e) The plans include a planter bed on the eastern boundary and retention of
existing planting at natural ground level around the sewer on the western
         boundary.
      f) The proposed works are considered to be consistent with adjoining
development as they are matching the approved pool and fencing located at
         2/35 Viewland Dr.
      g) The proposed works will not create any adverse impacts to ecologically
         sensitive areas.
