RFI response
Tuesday, 10 December 2019 Our Ref: 19360 / Office: Sunshine Coast Council Ref: MCU19/0134 NOOSA COUNCIL PO BOX 141 TEWANTIN QLD 4565 ATTENTION: The Chief Executive Officer Dear Sir INFORMATION RESPONSE DEVELOPMENT PERMIT FOR MATERIAL CHANGE OF USE FOR ENTERTAINMENT AND DINING BUSINESS TYPE 3 BAR ASSOCIATED WITH APPROVED INDUSTRIAL BUSINESS – TYPE 2 PRODUCTION, ALTERATION, REPACKAGING AND REPAIRING 5 TAYLOR COURT, COOROY LOT 5 SP197517 Further to your information request for the abovementioned development application we now respond to all of the information requested. START INFORMATION RESPONSE 1. Provide the proposed operating hours of the proposed Bar use and supporting details demonstrating compliance with Specific Outcome O1 of the Cooroy & Lake Macdonald Locality Code. In this regard, particular consideration must be given to the other industrial tenancies of the approved industrial development of 5 Taylor Court (MCU18/0120). Response: The tasting bar will operate: • 3pm to midnight on Fridays; • 12pm to midnight on Saturdays and Sundays. It is noted that Council has permitted similar hours of operation for tasting bars associated with breweries in industrial areas. The nearest residential dwellings to the subject tenancies are located approximately 380m to the east (across the highway), 440m to the south-west and 600m to the south. The Noise Impact Assessment prepared by David Moore Acoustics for the industrial development approval for the site confirmed that an appropriate noise environment could be achieved for 24 hour use. The proposed tasting area is within a tenancy that was included in this previous noise assessment. On this basis, it is reasonable to assume that no noise control measures would be required for the proposed development. Lighting will comply with the relevant Australian Standards. There will be no changes to air quality or any other conditions enjoyed by adjoining or nearby uses. The proposal complies with the Specific Outcome.

2. Provide details and material demonstrating compliance with Specific Outcome O7 of the
Driveways and Carparking Code, prepared by a suitably qualified and experienced traffic
engineer.
Response: Council’s assessment report for MCU18/0120 identified that 54 car parking spaces were
required for the overall industrial development. 59 spaces are provided in the estate which equates to
a five (5) space surplus to that required by the planning scheme. Four (4) parking spaces are proposed
to be allocated to tenancy 1 and there will be a substantial pool of unallocated parking spaces within
the industrial estate. The proposal complies with Specific Outcome O7.
3. Provide amended proposal plans detailing the gross floor area of the subject tenancies
(including mezzanine) consistent with the original development approval over the site
(MCU18/0120).
Response: MCU18/0120 included the following floor areas associated with tenancies 1 & 11:
Tenancy 1 Ground Level = 110.3m2
Tenancy 1 Mezzanine = 36.45m2
Tenancy 11 Ground Level = 77.8m2
Total tenancy 1 & 11 = 224.5m2
Amended proposal plans are enclosed which align with these previously approved floor areas.
4. Provide amended proposal plans detailing the proposed use area of the proposed Bar use in
accordance with the use area definition of The Noosa Plan. It is recommended both male and
female toilets be provided within tenancy 1 for suitable access and use by patrons of the
proposed Bar use. The use area of the proposed Bar use may need to be amended considering
items 1, 2 and 3 above. The use area of the proposed Bar use must not exceed 20% of tenancy
1 and 11 combined
Response: Amended proposal plans identify the use areas associated with the tasting bar. These
equate to 39.8m2 which is less than 20% of the overall floor areas of tenancies 1 & 11.
5. Provide an indication of when all of, or part of the distillation and holding equipment will be
installed (in stages or in the first instance).
Response: All distillation and holding equipment will be installed prior to opening the tasting bar.
