                 Dear Sir/Madam,
                                         Referral Agency Response - Refusal
                                                       Planning Act 2016

I refer to your application and advise that Council, as a referral agency for the application,
completed its assessment of the application on 2 February 2026. You are advised that Council
refused the application. Reasons for refusal are detailed below.
                 1. APPLICATION DETAILS

                     Application No. ERR25/0009

Street Address: 80 Lorikeet Dr, Peregian Beach Qld 4573

Real Property Description: Lot 2 RP 862526

Planning Scheme: Noosa Plan 2020 (26 September 2025)

                 2. TYPE OF DEVELOPMENT

The applicant seeks the following type of development approval:
                 • Early Referral Response – Additions to Dwelling House (Building Setbacks)
                 3. REASONS FOR REFUSAL

                 1. The proposal does not comply with PO9(a) of the Low Density Residential Zone Code
as the extent of built form within reduced front and side setbacks results in diminished
visual openness, increased bulk, and reduced amenity for both occupants and adjoining
properties. PO9 requires development to maintain a high level of amenity, including
visual privacy and access to sunlight, which the proposal fails to achieve.
                 2. The proposal does not comply with PO9(c) of the Low Density Residential Zone Code
as the reduced side setback for the carport does not provide an adequate separation
distance, undermining the low‑density spatial character intended for the zone. Such
intrusions into boundary setbacks compromise the perceived separation between
dwellings and do not satisfy the required performance outcomes.

                 3. The proposal does not comply with PO9(d) and PO9(e) of the Low Density Residential
Zone Code as the proposal restricts opportunities for meaningful ground‑level
landscaping and fails to demonstrate retention or replacement of vegetation that would
soften the built form. The reduced setbacks leave insufficient space for appropriate tree
and shrub planting to buffer the development, contrary to PO9’s requirement for
landscaping to contribute to residential character and amenity.
                 4. The proposal does not comply with PO9(f) of the Low Density Residential Zone Code of
the proposed carport and associated structures are located well forward of the
established 6 m front setback and present as visually dominant elements within the road
boundary setback. This siting is inconsistent with the predominant character of the
streetscape, which is defined by buildings and larger structures being set back behind a
uniform front alignment. Such forward‑projecting structures are not considered
consistent with the predominant streetscape form.
                 5. The siting of the proposed carport and trellis (new arrival over front courtyard) does not
meet Overall Outcome (2)(c) of the Density Residential Zone Code as the development
makes a positive contribution to the desired character of the residential neighbourhood
by achieving small scale well-designed buildings and landscaped outcomes that
enhance an open and green streetscape.
                 4. REPRESENTATIONS ABOUT REFERRAL AGENCY RESPONSE

                 Not applicable.
