                     (b) are setback a minimum of 6 metres from the seaward boundary (see Figure 8.2.4.4).




               The proposed development does not comply with Performance Outcome PO3(a) of the Coastal
               Protection and Scenic Amenity Overlay Code. Specifically, the parts of the dwelling comprising
               the combined kitchen/dining/living area and the outdoor living/dining area (as identified in Figures
               7 and 8) are either enclosed or covered, and therefore do not constitute uncovered, unenclosed
               cantilevered balconies, as required by PO3(a) of this code. These elements of the proposed built
               form extend approximately 5 metres seaward of the coastal building line, resulting in non-
               compliance with the intended setback provisions and visual amenity outcomes prescribed by this
               code.
