2. Attachment 2 - Specialised Supplier List
EXECUTIVE SUMMARY
The procurement of all Council’s goods and services must be carried out in accordance with the
Local Government Act 2009 (Act) and the Local Government Regulation 2012 (Regulation).
Specifically, the Regulation outlines the Local Government default contracting procedures, for
entering contracts via written quotes or tenders.
The Regulation includes exceptions to these procedures under certain circumstances such as the
engagement of a supplier without first inviting written quotes or tenders where they are approved as
a sole or specialised supplier.
This report seeks to amend both the Sole Supplier List and the Specialised Supplier List to continue
to support Council’s current and future procurement requirements.
RECOMMENDATION
That Council:
A. Note the report by the Strategic Procurement & Contracts Advisor to the General Committee
Meeting dated 6 October 2026;
B. Note the administrative process undertaken to establish and maintain the Sole and
Specialised Supplier Lists;
C. Adopt the Sole Supplier List provided at Attachment 1 of the report for the next twelve (12)
months; and
D. Adopt the Specialised Supplier List provided at Attachment 2 of the report for the next twelve
(12) months.
REPORT
The Local Government Regulation 2012 (Regulation) governs how a Local Government enters
contracts for Goods and Services through inviting written quotes or tenders. In addition, the
Regulation outlines a range of 'exceptions' for a Local Government to enter contracts without first
inviting written quotes or tenders.

GENERAL COMMITTEE MEETING 6 OCTOBER 2026
This includes entering contracts off a range of established arrangements as follows:
For the purposes of this report the Regulation outlines the following exception:
235 Other exceptions
A local government may enter into a medium-sized contractual arrangement or large-sized
contractual arrangement without first inviting written quotes or tenders if;
(a) the local government resolves it is satisfied that there is only 1 supplier who is reasonably
available; or
(b) the local government resolves that, because of the specialised or confidential nature of
the services that are sought, it would be impractical or disadvantageous for the local
government to invite quotes or tenders.
For the purposes of exceptions (a) and (b) above Council refers to these categories as ‘Sole’ and
‘Specialised’ respectively and has subsequently established supplier lists for both.
Sole and Specialised Supplier Lists - Administration
The Sole and Specialised Supplier Lists are generally reviewed and updated on an annual basis
(with the process commencing in August each year) to ensure their appropriateness and currency,
including seeking Council approval. The Procurement Branch, in consultation with Departments,
undertakes the following process in this regard:
1. Seeks nominations from across Departments,
2. Reviews nominations in the context of the exception outlined above and identifies appropriate
additions,
3. Reviews the existing Sole/Specialised Supplier lists and identifies appropriate removals and
amendments,
4. Reports the revised lists to Council for consideration/approval.
A resolution to adopt the updated lists will allow Council to continue to engage with these suppliers
in a more timely manner than if inviting written quotes or tenders.
