In particular the applicant seeks to change the design of the approved cabins to two (2) permanent
modular buildings in the same location as the approved cabins.
This is due to building certifier advice that the approved cabins would not be able to meet the
energy efficiency, bushfire and waste management requirements under the National Construction
Code.
It is proposed that this development be staged with the northern cabin (Cabin 1) presenting stage
1 and the southern cabin (Cabin 2) presenting stage 2
Both Cabins contain the same floor plan, containing a single bedroom, as well as a combined
kitchen, living and dining area. The cabins will have a Gross Floor Area of 46.48m2 and each have
a deck area of 30m2.
The proposed cabins are modular (high-set) structures and contain a height of approximately 4
metres above ground level. The façade of the structures will comprise of horizontal weatherboard
cladding, pitched skillion roof forms and will be finished with muted earthy tones.
The locality and proposal plan are included below.

2. BACKGROUND
A development approval for a short term accommodation (2 cabins) was approved 22 September
2025.
3. ASSESSMENT
3.1. Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following
statutory planning instruments to the extent they are relevant to the development:
• State Planning Policy;
• South East Queensland Regional Plan;
• Planning Regulation 2017; and
• Noosa Plan 2020 (20 March 2026).
3.2. Statutory Process
The applicant has requested to make a minor change to a development approval under s78 of the
Planning Act 2016. An application for a minor change to a development approval can only be made
in circumstances where a change would constitute a ‘minor change’.
The proposed change to the development approval requested by the applicant is determined to
constitute a minor change on the grounds that:
• the development would not result in substantially different development;
• the change does not include prohibited development;
• the change would not require the application to be referred to an additional referral agency or
cause a referral agency to have regard to new matters prescribed by regulation;
• where the original application was code assessable, the change would not cause the
application to become impact assessable.
3.3. Statutory Instruments – Planning Scheme
The original application was lodged and assessed under the now superseded Noosa Plan 2020
(25 September 2020). Pursuant to s81 of the Planning Act 2017, Council must consider the
planning scheme in effect when the original development application was lodged, however Council
may give weight to Noosa Plan 2020 (20 March 2026) as the planning scheme in effect at the time
of the minor change application being lodged.
The following codes from Noosa Plan 2020 are applicable to this development:
• Rural Zone Code;
• Visitor Accommodation Use Code;
• Works Codes;
• Biodiversity, Waterways and Wetlands Overlay Code;
• Bushfire Hazard Overlay Code;
• Landslide Hazard Overlay Code
The application has been found to generally comply with all applicable statutory instruments. The
pertinent issues arising out of the assessment are discussed below:

Bushfire Hazard
Assessment
The Table of Assessment triggers assessment against the Bushfire Hazard Overlay Code for
Short-term accommodation in 2 cabins.
The cabins are identified within a potential impact buffer, however they are generally clear of
vegetation and are located below the ridgeline. As the proposed cabins are of similar design and
scale and on the same location as the approved cabins, no change to the existing conditions are
required.
Landslide Hazard
Assessment
The existing geotechnical assessment is to be revised to reflect the revised cabin and siting
location. Condition revised accordingly.
Agricultural Land Conservation Area (ALCA)
Assessment
As the proposed cabins are of similar design and scale and on the same location as the approved
cabins, the proposal is considered compliant with Performance Outcome 2 of the Rural Zone Code.
Existing Condition 2 – Approved Plans
