REPORT
A report on this application was considered by the Planning and Environment Committee
Meeting on 9 November 2021 and was subsequently referred to the General Committee
Meeting on 15 November 2021 with a further report requested to address condition 99 and the
applicant’s comments received around this recommended condition.
99. The ‘Cooking Classes’ room must not be used as part of the approved Entertainment
and Dining Business use.
During the assessment of the current application, it was noted that the proposed ‘Cooking
Classes’ area was replacing an area previously identified on the plans as a shared multi use
space. To protect the shared space, the condition was included in the report to the Planning
and Environment Committee on 9 November 2021.
At the time the development was originally approved in 2007 several associated facilities were
also approved providing shared common facilities for occupiers of the development. A
condition of the approval required the facilities building to be provided prior to the
commencement of use of the 64th dwelling unit. In essence, the approval sought to ensure the
delivery of these shared facilities for the future occupiers of the development.
Overtime, through numerous change applications, the internal layout of the building has
changed however shared common facilities were always provided.
The applicant has subsequently advised Council officers that whilst it was not articulated in the
application material it is intended the ‘Cooking Classes’ area be used in conjunction with the
restaurant. The cooking class area is to be utilised by the restaurant’s signature chef who will
provide a cooking class experience for a small number of guests.
The acoustic report submitted with the application addresses the potential impacts of the
cooking classes on surrounding residents and identifies that no adverse impacts will result.
Furthermore, no additional car parking is required associated with the cooking class use.
On this basis and given the approval still provides the option for this space to be used as a
shared space in the future, it is no longer necessary to include condition 99 and the
recommendation has been revised accordingly.
