2.1. Background
A Development Permit for Building Works DA 20140118 was granted by Pacific BCQ on 15 July
2014. The Approved Plans are annotated indicating that no part of the building was to encroach
into the 4.5m setback. A complaint for works under construction within the 4.5m setback area
triggered enforcement action and an application for a garden wall was submitted.
The application was a Preliminary Building Approval Assessable against the Planning Scheme
PBA14/0018 for which approval was granted for the garden wall. This application assessed the
garden wall in regard to flood storage, impacts on the revetment wall and amenity.
The applicant suggests that the subject encroachment of this current application should have
been addressed as part of PBA14/0018. Application PBA14/0018 was for a garden wall and
works subject of this application (RAP14/0040) were under construction at the time, and were
subject to a Building Approval under the jurisdiction of the Private Certifier.
