The application assessed in accordance with the applicable statutory instruments of the time and
approval granted on 27 October 2021.
2.2. Site Description
The site is densely vegetated and generally grades towards the south.
2.3. Surrounding Land Uses
The adjoining land is zoned low density and rural residential.
3. ASSESSMENT
3.1. Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following
statutory planning instruments to the extent they are relevant to the development:
• State Planning Policy;
• South East Queensland Regional Plan;
• Planning Regulation 2017; and
• Noosa Plan 2020 (26 September 2025).
3.2. Noosa Plan 2020
The following codes from the Noosa Plan 2020 are applicable to this development:
• Works Codes
The application has been found to generally comply with all applicable statutory instruments. The
pertinent issues arising out of the assessment are discussed below:
External Works
The external works to Pottery Street and the Pottery / Red Street intersection is consistent with the
higher order approval. The design was referred to Infrastructure Services for discussion where
some minor alterations to the location of a pram ramp and asphalt alignment were requested.
As part of the proposal, the existing, unformed secondary driveway servicing Lot 1 of RP71117 is
to be impacted due to the reshaping of the road shoulder. The applicant has indicated that this
driveway crossover will be reconstructed. Council records suggest this driveway hasn’t been
approved by Council. Council does not oppose these works but recognise that this application is
the wrong application type to have that secondary driveway approved.
New Road
The proposed new road remains consistent with the higher order approval and complies with the
requirements of Planning Scheme Policy 6.
Access to Proposed Lots
Access is provided to Lots 6 – 9 in accordance with the higher order approval.
The higher order approval did not specify that proposed Lots 1 – 5 were to be provided with a
driveway crossover prior to Council signing the Plan of Survey.
Earthworks
The proposed earthworks incudes a cut-to-fill strategy that sees 2,373m3 of earth cut and filled
across 2,397m3 of the site. The balance indicates that ~25m3 of material will need to be imported
into the site.
The works are generally consistent with the higher order approval and have been designed by a
RPEQ.
