4.3.3 District Centre Zone Code
The purpose of the District Centre Zone Code is to provide for a large variety of uses and activities
that service the district and the needs of community and visitors. The Code specifically details that
development in Diyan Street is to include a mix of residential and entertainment and dining uses
but does not include shops. The proposal, including the outdoor dining and seating areas, is
consistent with this outcome.
The code also requires development to include crime prevention elements in the design.
Conditions have been included addressing the provision of signage, lighting and CCTV on site for
safety and security.
4.3.4 Entertainment Activities Code
The proposal has been reviewed against the Entertainment Activities Code the purpose of which
is to ensure the entertainment facilities are developed in the context of the locality and character
to which they are located. Whilst the development is a substantial expansion it is considered to
contribute to the local economy and vibrancy of the area and has been designed to add to the
streetscape.
Conditions of approval have been included to mitigate against potential impact from noise as
described below.
Noise
As part of the development application process, the applicant submitted several Noise Impact
Assessments to address the impacts of noise on the surrounding areas.
The reports have been reviewed by an external acoustic expert who has confirmed that the
proposal is acceptable subject to conditions relating to:
   Hours of Operation – Servicing
      • Loading, unloading and delivery activities associated with the operation of the use only
to occur between the hours of 7:00am and 6:00pm.
      • Collection activities associated with the operation of the use only occur between the
          hours of 7:00am and 6:00pm.
