Town planning report
6 CONCLUSIONS—REASONS FOR APPROVAL
Council should make the following conclusions from this report—
(1) the development application has been made in accordance with the
requirements of the Planning Act 2016 and Planning Regulation 2017;
(2) this report addresses the relevant assessment benchmarks, including the
performance outcomes and acceptable outcomes of the applicable codes
in the Noosa Plan and the State Planning Policy;
(3) the proposal would service the needs of local customers without impacting
the role and function of higher order activity centres;
(4) the site is appropriately zoned for the proposal, and the proposal is
explicitly anticipated by the planning scheme;
(5) the proposal incorporates a high standard of design that appropriately
responds to local character, environment and amenity considerations;
(6) it is a relevant matter3 that the proposal would replace development that
has similar or greater scale, and in doing so significantly improve the
environmental performance of the site, including improved visual amenity,
landscaping, traffic movement, pedestrian safety, noise, light, stormwater
quality, and VOCs; and
(7) transport infrastructure would be provided in a manner that meets the
needs of development without generating off-site impacts.
Council should therefore approve the application in full subject to reasonable and
relevant conditions.
3
Council may have regard to ‘any other relevant matter’ under the Planning Act 2016, s45(5)(b). The
Planning Regulation 2017, s31(1)(f) requires that the assessment be carried out having regard to “any
development approval for, and any lawful use of, the premises or adjacent premises”.
