PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 10 MAY 2022
Whilst the proposal increases the extent of retail space further above the 15,000m2 permitted under
the 1997 Strategic Plan it is noted that the approval currently allows for 18,000m 2 of floor space
with the additional 82m2 as requested by the applicant remaining less than the 18,300m2 supported
under MP2. The proposal therefore generally aligns with the strategic intent for the Shire Business
Centre in regard to the extent of retail floor space that was relevant at the time when the original
decision was made.
Under the Noosa Plan 2020 the site is included in a Business Park precinct and the proposed fast
food premises is defined as a food and drink outlet which is identified as a consistent use in the
precinct, subject to an impact assessable application.
The Noosa Plan 2020 includes a provision within the Major Centre Zone Code specific to the
Business Park Precinct regarding the permitted extent of Food and Drink Outlet. This is detailed
below:
The Noosa Plan 2020 is supportive of the establishment of Food and Drink Outlets within the
Business Park Precinct on the basis that they have a limited floor area. As detailed above, the
current proposal represents 1.64% of the approved 5,000m2 of commercial and business floor area
and is located amongst existing office and commercial activities. Therefore, while a reduction is
not desirable to the approved office space, and there is no need for a food and drink outlet in this
location, given its proximity to the shopping centre, the proposal is consistent with the AO69.
However, it is recommended that instead of approving an amended plan set and amending
condition 5.1 as proposed by the applicant it is more suitable to amend condition 5.4 only, with the
amendment allowing the subject tenancy to be used as a Fast Food Premises. This will ensure the
tenancy is not used in the future for retail shops whilst still enabling the tenancy to be used for the
commercial and business activities as intended by the original approval.
It is recommended that the amended condition read as follows:
5.4. The commercial and business floor space for the Commercial and Business component
shall not exceed 5,000m2 TUA. The uses allowed within the Commercial and Business
component are:
Commercial Premises
Commercial Services
Medical Centre
Professional Offices
Warehouse
Educational Establishment, and
Special Purposes
5.4(a) 82m2 of tenancy BB-03 (as detailed on the Site Plan Q0201.01.1b/U/0222MC) may
only be used as Fast Food Premises
The changes as proposed by the applicant are supported on the basis that they are consistent with
the planning scheme applicable when the original approval was granted and the current Noosa
Plan 2020.
