Entertainment and Dining Business means the conduct of a business activity, where entertainment,
amusement, recreation or meals are afforded. The term includes the following types:
Type 2 Recreation, Amusement & Fitness “The use of premises involving recreation or amusement

AND
Reconfiguration of a lot

Town Planning Assessment – These definitions accurately reflect what is proposed to occur on the subject
land by this application. The development has been specifically designed to deliver an integrated
community consisting of independent living units and community facility buildings that will accommodate
an active over 50s demographic, co-located with a new club house for the Cooroy Golf Club.
Level of Assessment and Public Notification
67. The proposed development application is made ‘Impact Assessable’ pursuant to development
assessment Table 6.8 for Material Change of Use within the Rural zone (Division 10) of the Cooroy
and Lake Macdonald Locality Plan (Part 6) of the Noosa Plan 2006. The level of assessment is
unchanged by the applicable overlay assessment tables (Part 13) of the Noosa Plan 2006. As such,
the proposed development is required to be publicly notified for a period of 15 business days.
Draft Noosa Plan
68. The Draft Noosa Plan was released on 15 February 2019 for public consultation and proposes to

the subject land, the Draft Noosa Plan appeared to acknowledge that the current zoning of the
majority of the subject land, by virtue of its inclusion in the Rural zone, did not truly reflect the
locational characteristics and site attributes. In this regard, it is noted that the Draft Noosa Plan
proposed to up zone the subject land and include it within the Rural Residential Zone.
69. Whilst the proposed up zoning of the subject land is acknowledged, it is suggested that it did not go
far enough in responding to the economic and social needs of the local community by way of the
provision of affordable (and alternate) housing options for the ageing population. For this reason,
on behalf of GemLife and in conjunction with the Cooroy Golf Club and the current landowners of
Lots 2 and 3, a submission in respect of the proposed Draft Noosa Plan was lodged with Council for
consideration within the public consultation period. The submission was premised on the community
benefit that would be capable of being achieved in the form of a development concept not dissimilar
to that which is proposed by this development application. Representations were therefore made
on this basis. We understand that Council is currently in the process of considering submissions to
the Draft Noosa Plan and we suggest that this development application now offers the technical
