PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 6 DECEMBER 2016
15. Any construction and post construction activity is not to impact on the condition of the
waterway, and is to be conducted so as not to breach the Environmental Protection Act
EPA (1994) and the Environmental Protection (Water) Policy 2009.
16. Certification by a Registered Professional Engineer of Queensland that states that the jetty
and boatlift are constructed in accordance with best practice methods and are structurally
sound must be submitted to Council. This certification must be submitted to Council within
three (3) months of the completion of the works. A final inspection and approval of the
structure by Council’s Inspector is also required. Please contact Council’s Planning
Assessment Section (Development Audit & Response Officer 0428738563) to arrange the
inspection.
17. This approval lapses where the construction of the jetty has not commenced within two (2)
years of the date of issue of the approval, unless application is made and approved by
Council for an extension.
18. After completion, the proposed works must be maintained in a sound state of repair in
accordance with the approved plans
REPORT
1. PROPOSAL
The application is for a new jetty and the installation of a boat lifting device (drive on pontoon).
The jetty will replace an existing jetty.
The new jetty is significantly different to the existing jetty in regard to size and shape and extends
further into the canal.
2. SITE DETAILS
2.1. Background
The subject site is part of a Group Title development in which each property has a direct frontage
to the canal.
The subject site is unique in that it has an approval for the jetty in a group title development that
does not share the jetty with an adjoining property.
Council addresses the potential for issues created by multiple jetties in the canal frontages of
group title developments by the use of Codes and Planning Scheme Policies.
Historically there have been a number of approvals for jetties across the frontages of the subject
group title development:
May 1997 - Council approved 2 jetties, one exclusively for Lot 1 and another between the
boundaries of Lots 5 & 6 to be shared by those unit owners
February 2005 – Council approved a joint application for Lots 3 & 4
The current applicable documents within The Noosa Plan are:
Watercourses Works Code – (Specific Outcome O12 and Probable Solution S12.7), and
Planning Scheme Policy 25 – Domestic Marine Uses in Noosa Waters Estate. (section
1.20)
These documents have not significantly changed from the previous policies. The intent of the
code and the planning scheme policy is to ensure that jetties are designed and constructed for
the sole purpose of providing access to vessels and are sited and designed to avoid cluttering of
watercourses, excessive traffic and unacceptable risks to personal and public safety.
