Planning Assessment Report Page 13 300 Kennedys Road, Lake Macdonald QLD 4563 – Extractive Industry Development in distributor-retailer’s geographic area Development in the area of a local government Sunshine Coast Regional Concurrence Agency Table 3, Item 26 that, under the SEQ Water Act, is a participating Council local government for a distributor-retailer, if the development application is made before 1 July 2013. The IDAS process coordinates the assessment of development applications at State and local government level through the provision of various planning instruments. State and local government planning instruments relevant to the proposed development are considered in section 3.3 and section 3.4 of this Report. 3.4 State Planning Instruments 3.4.1 Environmental Protection Act 1994 The IDAS process also coordinates the approval of Environmentally Relevant Activities (“ERAs”). In addition to a development approval under the SPA, the Environmental Protection Act 1994 (“EP Act”) requires that any person carrying out an ERA must hold, or be acting under, a registration certificate for the activity. In accordance with the Environmental Protection Regulation 2008 (“EPR”), the following ERAs are proposed to be carried out on the subject Site (refer TABLE 2 – PROPOSED ERAs AND THRESHOLD): TABLE 2 – PROPOSED ERAS AND THRESHOLD Proposed ERA and Threshold AES Annual Fee ERA 16 – Extractive and Screening Activities (2) extracting, other than by dredging, in a year, the following quantity of material: 39 $8,611.20 (c) more than 100,000 t to 1,000,000 t. ERA 16 – Extractive and Screening Activities (3) screening, in a year, the following quantity of material: 29 $6,403.20 (b) more than 100,000 t to 1,000,000 t The environmental management and monitoring of the above activities is shown in the Site Based Management Plan (“SBMP”) prepared for the Site. The SBMP provides the framework for environmental management on the Site and is a practical guide at the operational level to contain environmental impacts. The SBMP has been prepared to assist in the management and protection of surrounding environment values and describes how the operator proposes to manage potential environmental impacts which may be caused by carrying out extractive and processing activities (refer ATTACHMENT 8 – SITE BASED MANAGEMENT PLAN). 3.4.2 Vegetation Management Act 1999 The Vegetation Management Act 1999 (“VMA”), in conjunction with other state legislation, regulates the clearing of native vegetation in Queensland. The Queensland State Government Regional Ecosystems Map shows the Site as comprising portions of remnant vegetation that is: endangered; endangered (essential habitat); and of concern.
