Planning Assessment Report Page 27 300 Kennedys Road, Lake Macdonald QLD 4563 – Extractive Industry z) For the Rural Zone – rural land is protected and appropriately managed such that scenic and environmental values, the distinct rural amenity of the locality and agricultural productivity of the locality are preserved and are not adversely impacted upon as a consequence of development on or adjacent to that land; RESPONSE: Refer to response to Overall Outcomes for the Cooroy and Lake Macdonald Locality: a), d), g), l), p), q) and r) above. 3.5.5 Assessment Level Each zone (of each locality) and each overlay comprise assessment tables which identify the level of assessment for development within the area covered by the zone (of each locality) or the overlay. The level of assessment is determined by using development classifications generally consistent with the Sustainable Planning Act 2009. Assessment tables distinguish between exempt, self assessable, code assessable and impact assessable development. The Rural Zone (of the Cooroy & Lake Macdonald Locality) assessment table for a material change of use is shown in Part 6, Division 10 of the Planning Scheme and outlines the assessment category for a “Industrial Business Type 3 – Extractive”. Under the provisions of the Planning Scheme, a material change of use for “Industrial Business Type 3 – Extractive” in the Rural Zone is “Impact Assessable” and is identified as being a “consistent use” in the Rural Zone. 3.5.6 Desired Environmental Outcomes The Desired Environmental Outcomes (“DEOs”) are the core of the Planning Scheme. They provide the fundamental context of the Planning Strategies and subsequently, for the development assessment codes and other measures contained in the remaining parts of the Planning Scheme. The DEOs are based on ecological sustainability established by the SPA and are the basis for the measures of the Planning Scheme. DEOs are grouped under the following headings: a) Agricultural Uses. b) Commercial & Retail Uses. c) Community Uses & Facilities. d) Heritage. e) Industrial Business Use. f) Natural Resources. g) Open Space, Environment & Conservation Functions. h) Sport & Recreation Uses. i) Residential Uses. j) Tourism. k) Transport & Mobility Functions. l) Infrastructure & Services. The DEOs and comments relevant to the proposal for the Local Government Area are addressed as follows: a) AGRICULTURAL USES Agricultural industry is maintained by – i. conserving land for economically viable and environmentally sustainable agricultural purposes; RESPONSE: Portions of the Site are shown on the Noosa Shire Planning Scheme Overlay Mapping (OM3.5 Natural Resources Overlay Map) as comprising “Agricultural Land Conservation Area”. However, OM3.5 Natural Resources Overlay Map also shows a “Mining Lease” and “Local Resource/Processing Area” as overlapping the “Agricultural Land Conservation Area” over Lot 3 on SP108094. In addition, Council’s Planning Scheme Strategy Map identifies the Site as being in an area containing an “Extractive Resource”. December 2012 / file ref. 1271_DA1_310_001 GROUNDWORK p l u s
