Attachments 1. Proposed Tenure for Community Organisations
EXECUTIVE SUMMARY
Each year Council is provided with a report which identifies expiring community leases to not-
for profit organisations and proposed new leases with Council. In accordance with the Local
Government Regulation 2012, Council may only enter into new lease agreements with
community organisations without undertaking a public tender if a Council resolution is
obtained. A list of the relevant community organisations is provided in Attachment 1.
RECOMMENDATION
That Council note the report by the Property Officer to the Services & Organisation Committee
Meeting dated 12 July 2022; and
A. Authorise the Chief Executive Officer to enter into tenure renewal negotiations with
community organisations noted in Attachment 1, in accordance with the Community
Purpose Land and Infrastructure Tenure Policy; and
B. Apply the exception to the requirement for tendering under Section 236 (1) (b) (ii) of the
Local Government Regulation 2012 for disposal of a non-current asset other than by
tender or auction if the valuable non-current asset is disposed of to a community
organisation.
REPORT
The purpose of this report is to seek Council approval to enter into tenure arrangements with
two not-for-profit community organisations listed in Attachment 1. The tenure agreements will
be negotiated in accordance with the Community Purpose Land and Infrastructure Tenure
Policy endorsed by Council at the March 2015 Ordinary Meeting.
In accordance with the Local Government Regulation 2012 section 236, Council may dispose
of an interest in a non-valuable asset, including granting of a lease over land or a building
without the need to complete a tender process if a relevant exception applies.
Accordingly, the relevant exception is referenced in Section 236 (1) (b) (ii) whereby Council is
not required to go out for public tender given the purpose of the tenure is to community
organisations.
To apply this exemption a Council resolution is required.
