PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 6 NOVEMBER 2018
With regards to condition 36 the applicant advises:
Following issue of Councils decision notice, the applicant met with Council staff to address the
requirements and conditions of the preliminary approval. During these discussions the applicant
noted that the condition required the dedication of an area of the site that included existing
pathways, seating and lawn areas that were used for passive and active recreation by residents.
This area is clear of the crayfish habitat and is a landscaped area that will be maintained in its
current state.
As this area is part of the landscaped setting and is not in its natural state, the applicant requests
that this landscaped area be excluded from the area required to be dedicated to Council for
environmental park as detailed on Middap Architecture Pty Ltd - Plan MCU. 02A. (excerpt below).
The applicant notes that a 2.1 metre high pool fence will be required to be constructed along this
boundary for the safety of residents. Advice has been received from Cardno that the proposed
fence and revised building layout will lessen the potential for negative impacts or drainage
blockages.

The applicant proposes that the condition be amended for the parkland dedication to reflect the
location as detailed on Middap Architecture Pty Ltd Plan MCU 02A.
Assessment
The proposed plans demonstrate compliance with the conditions of approval and result in the
removal of 2 accommodation villas from within the Q100 flood area. There will be no new works
within the Q100 flood area. This has resulted in the reduction of additional beds from the
originally proposed 48 to 32, bringing the total number of beds to 174 beds. 161 car spaces have
been provided which complies with the required rate of 0.92 spaces per bed.
The amended plans also seek to use some areas within the Q100 flood area which are currently
occupied by an existing path, a section of mown lawn with scattered trees and an area to the
east of the car park for the purpose of fire management measures. The applicant also seeks for
these areas to be removed from the area to be dedicated as Environmental Park. The use of
these areas for bushfire management purposes will result in the management of the understorey
with the existing trees, including swamp paperbark, retained. The mown area is suitable to use
for bushfire management purposes as it has been developed with infrastructure that has served
