PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 6 NOVEMBER 2018
not able to be utilized in association with dementia care. The condition is requested to be
amended to accordingly.
A permanent fence must be constructed along the interface of the development site with
the lands area to be dedicated. The fence must be constructed in accordance with an
Operational Works approval and must be to the following specifications:
a. 2.1 metre high
b. Pool fence with vertical bars at 100mm centres (or similar)
c. Educational signage for wetlands protection.
Assessment
It is recognised that the requirement for a chain wire fence creates the opportunity for residents
to climb the fence. This is not a desirable outcome for a dementia care facility as ensuring that
residents are safely contained is an important element of dementia care. The proposed change
to the condition is supported as the amended fence will provide a suitable practical outcome and
address the intent of the condition. It is recommended that the condition be amended as follows:

5. CONCLUSION & REASONS FOR DECISION
The applicant has made representations to a Preliminary Approval for a Material Change of Use
– Multiple Housing - Type 3 Retirement and Special Needs which was issued on 21 August 2018.
The applicant has provided plans which generally comply with the required amendments. The
amendments have resulted in the removal of development below the Q100 flood line and
reduced the development from an additional 48 beds in 6 accommodation villas to an additional
32 beds in 4 accommodation villas. Therefore, a Development Approval may now be issued.
It is further recommended that the area to the east of the car park and a lawn and paved area be
excluded from the area to be dedicated as Environmental Park and that conditions relating to the
type of wetland fencing, approved technical reports and the area of the drainage easement be
amended and updated to reflect the new plans and reports.
