• Plans showing additional screens for units HO5, TH07 & TH08 to ensure compliance with
Conditions 14 & 15 of the approval.
• Plans addressing existing Conditions 20 & 21 to ensure amenity is preserved to adjoining
property from the car park. In addition to the constructed boundary fence, the applicant
has constructed an acoustic rated screen at a 1.8m high and wraps around from the loading
bay to the 5th car parking space as detailed in Figure 1. The additional fence is to ensure
headlights and noise is attenuated from the car park.

entry area and refuse/tank pump room area. This includes additional plantings to ensure
screening of the built form is sufficient.
2. BACKGROUND
• A development approval for a Development Permit for Material Change of Use of Premises
(Multiple Dwelling) was approved on 4 April 2022.
• The applicant suspended the appeal period and made representations on 13 May 2022 to
the development approval conditions and a negotiated decision notice was issued on 2
June 2022.
• A minor change was approved on 30 June 2022 that sought to vary the setback of the front
fence.
3. ASSESSMENT
3.1. Instruments for Statutory Assessment
The following codes from the Noosa Plan 2020 are applicable to the proposed changes:
• Noosaville Local Plan Code;
• Medium Density Residential Zone Code;
• Dual Occupancy and Multiple Dwelling Code;
• Works Codes.

A compliance inspection was held in December 2023 that identified some minor works and
variation to the approved plans. The applicant has provided amended plans that ensure
compliance with the existing conditions and are generally in accordance with the approval.
The acoustic screen and additional privacy screens to the subject 3 units (adjoining the child care)
shown on the plans provided by the applicant ensure compliance with the relevant conditions.
Council’s Senior Environment Officer has assessed the changes to the landscaping and is satisfied
with the changes which include additional screening of the front fence, refuse and mechanical plant
area to ensure longer term screening of the built form.
The development is considered generally in accordance with the development permit.

5. CONCLUSION & REASONS FOR DECISION
The changes are considered minor and are in keeping with the approval and can be considered
generally in accordance with the approval. The proposed development generally complies with the
requirements of the planning scheme and does not raise any significant issues that cannot be
addressed by reasonable and relevant conditions. The generally in accordance request is therefore
recommended for approval.
The report is provided in accordance with Section 63(5) of the Planning Act 2016.
RECOMMENDATION
With regard to Application No.MCU21/0156.02, seeking confirmation that the proposed changes
are considered generally in accordance with the development approval for Material Change of Use
for 22 x Multiple Dwelling Units - Generally in Accordance situated at 89 - 91 Eumundi Noosa Rd
