6    MCU16/0130 - REQUEST FOR NEGOTIATED DECISION NOTICE FOR MATERIAL
     CHANGE OF USE FOR RETAIL BUSINESS TYPE 6 - HARDWARE AND RETAIL
     BUSINESS TYPE 7 - GARDEN CENTRE AT 101 EUMUNDI NOOSA ROAD, NOOSAVILLE
     That Council note the report by the Development Planner to the Environment & Planning
     Committee Meeting dated 8 May 2018 regarding representations made to change conditions
     of a Development Permit for a Material Change of Use (MCU16/130) for Retail Business
     Type 6 - Hardware and Retail Business Type 7 – Garden Centre situated at 101 Eumundi
     Road, Noosaville and:
     A.   Agree to change condition 8 to read as follows:
          Nature & Extent of Approved Use
          8.      The approved use must not operate outside the hours of:
                  a.      7am to 6pm Monday to Friday
                  b.      8am to 5pm Saturday to Sunday or any public holiday
     B.   Agree to delete condition 7.
     C.   Refuse to delete condition 10.
     D.   Refuse to amend condition 2 but acknowledge that the plans detailed in the table below
          generally comply with the approved plans of development.

     QUARTER 2017-18
     That Council note the report by the Director Environment and Sustainable Development to
     the Planning and Environment Committee Meeting dated 8 May 2018 providing an update
     on operations of the Environment and Sustainable Development Department for the period
     1 January to 31 March 2018.




Recommendation

The Planning & Environment Committee recommendations dated 8 May 2018 be adopted except
where dealt with or held over by separate resolution.
