STEPHEN KIDD DESIGN
PO BOX 262 .
NOOSA HEADS QLD 4567

Dear Sir,

Re: Application for a Minor Change to a Development Approval for an extension to
the existing reception area and changes to landscaping at “Netanya Noosa”
complex Hastings Street, Noosa Heads described as Lot 1 on RP 214815, Parish of
Weyba

I refer to your request to make a minor change to the above development approval. On 9 June
1999, Council decided to approve the change, with the approved plans to comprise those
numbered 9846.02A & 03A, prepared by Stephen Kidd Design and dated February 1999.

Please note that this approval does not authorise the removal of the existing trees. ] understand
the plans intend for the existing trees to remain, especially the Poinciana. Please advise if this
is not the case.

Should you wish to obtain more information about Council’s decision, the reports and staff
recommendations regarding this application are available for viewing or purchase at the Level
3 counter of Council offices. It would assist Council staff if you could bring this letter with
you.

Yours faithfully,

Raul Weychardt

Strata-titling on amalgamation of the two sites, the
existing Netanya Building Units Titles Plan will be
extinguished and a new BUTP will be prepared for the
whole development site (47 units plus ancillary
facilities shops etc), for Council approval subject to
normal procedures. A Caveat will be placed on the title

Council by formal agreement with the developer to
prevent the sale of units in the development extension.
In the event that the development company wishes to sell
the new units (the subject of this T.P.C. application)
individually in the future, an additional 6 carparking
spaces will be provided on site (41, B/A design; plus 6
additional spaces =* 47 spaces) at the time of sale to
meet the potential increased residential parking needs
for the separate private ownership of units; and in
addition, a contribution of $30,000 (for 6 off-site
carparking spaces at $5000 per space) will be made at
that time to meet the public carparking needs of the
ancillary facilities (restaurant, shops, gym and meeting
room) for which no public carparking spaces would be
available on site at that time, and Council will
withdraw the caveat on the title.

Payment of the offered contribution to water supply and
sewerage headworks, ie- $16219.43 plus P.I. rises from.

The style, colour, landscaping features of the proposed
development shall be co-ordinated »with the existing

development.

-.Yours faithfully,

\a BSN a

8. ADVISORY NOTES

The following notes are included for guidance and information purposes only and do not
form part of the assessment manager conditions:

         Equitable Access and Facilities
1. The plans for the proposed building work have NOT been assessed for
compliance with the requirements of the Building Code of Australia – Part D3 as
they relate to people with disabilities. Your attention is also directed to the fact
that in addition to the requirements of the Building Code of Australia – Part D3 as
they relate to people with disabilities, one or both of the following may impact on
         the proposed building work:
         (a) the Disability Discrimination Act 1992 (Commonwealth); and
         (b) Anti-Discrimination Act 1991 (Queensland).
Sunshine Coast Regional Council recommends that the following matters be
considered to address equitable access and facilities in the building:
         (a) the building and environs should be designed to meet the requirements of
the Human Rights and Equal Opportunity Commission ―A dvisory Notes on
                 Access to Premises‖ and AS 1428.2;
         (b) applicants should be aware that a ―Di sability Standard on Access to
premises‖ is currently being developed and most likely will impose
changes on the Building Code of Australia; and
         (c) any services and facilities in the building complex should allow
independent, dignified and equitable use of the services and facilities for
                 all people.

         Aboriginal Cultural Heritage Act 2003
2. There may be a requirement to establish a Cultural Heritage Management Plan
and/or obtain approvals pursuant to the Aboriginal Cultural Heritage Act 2003.
The ACH Act establishes a cultural heritage duty of care which provides that: ― A
person who carries out an activity must take all reasonable and practicable
measures to ensure the activity does not harm Aboriginal cultural heritage.‖ It is
an offence to fail to comply with the duty of care. Substantial monetary penalties
may apply to individuals or corporations breaching this duty of care. Injunctions
may also be issued by the Land and Resources Tribunal, and the Minister
administering the Act can also issue stop orders for an activity that is harming or
is likely to harm Aboriginal cultural heritage or the cultural heritage value of
         Aboriginal cultural heritage.
