SERVICES & ORGANISATION COMMITTEE MEETING AGENDA 11 APRIL 2017
The successful contractor will be responsible for compliance with relevant laws relating to sale of
goods and workplace health and safety.
4. Duration of Licence to occupy
It is intended that the duration of the licence will be for an initial term of five years, followed by an
optional term of two years. This will bring the timing in line with the major waste contracts for
collection, landfill and resource recovery. Once that is achieved a further three optional terms of
12 months are recommended. Again this is directly aligned with the major waste contract timing.
Initial Term: 5 years
First Option: 2 Years
2nd 3rd and 4th Options: (1+1+1) year each.
Previous Council Consideration
Nil.
Finance & Risk
There are no significant risks associated with this Contract. It is unlikely there will be any substantial
payments made by Council to the contactor. The most significant risk is the performance of the
contractor and their ability to meet the expectations of Council.
Consultation
External Consultation - Community & Stakeholder
Legal advice was obtained from King and Company.
Waste Management staff met with Glenda Lane from Noosa Community Training Centre Inc. to
provide preliminary advice that Council intended to call a tender for the operation of the Briteside
‘Tip Shop’ after the current contract expires in August 2017. Briteside were informed that calling of
tenders was to attempt to align best practice standards for the future operation of the facility and
Briteside were encouraged to submit a tender.
Internal Consultation
A Councillor workshop was held on 2 February 2017 to discuss the Briteside Agreement. Council
requested legal advice on its ability to renew the agreement with Briteside.
At a Councillor workshop on 10 March 2017 Council considered the legal advice and its options
and following discussions, it was agreed that a licence to occupy the site was preferred and tenders
should be called. Staff were requested to report to Council and outline proposed terms and
conditions to be included in the licence for occupation of the site.
Procurement and Fleet were involved in providing advice on the need for renewal of the agreement
or calling of tenders.
