Dear Qint,
Thank you for taking the time to consider the unique circumstances that presently exists at the Noosa
Waterfront restaurant at 142 Gympie Terrace Noosaville.
Background Information
The present situation is presently more confused due to the Officers report before Council on the Noosaville
Foreshore Park and the commencement of the Noosaville Foreshore Masterplan. The challenges we are faced
with commenced just prior to these other processes commencing but now as they are within the public
domain it has made the understanding of our issues, just a little more difficult.
The matter we are seeking an interim solution / permit to relates to being able to gain a permit to use a small
portion of parkland (Appendix 2) that fronts the Noosa Waterfront Restaurant for functions, primarily
weddings (refer Figure 1, below). We are seeking this solution as it relates to only the functions and weddings
that are presently booked (Appendix 3). We are mindful of the Masterplan process and will actively engage in
the process but need a short term solution to assist with the present bookings.
The area of land is located directly adjoining the existing restaurant and has been used for this purpose for the
past six years. The current owner of the restaurant was under the firm beliefthat use of this land had obtained
the required approval, consistent with the On Premises Licence.
The area of confusion relates to his OLGR On Premises Licence (Appendix 1) which in reading appears to
provide approval for use of outdoor terrace area of 16m x 6.3m. This has been interpreted by the owner and
used in this manner to establish and grow the wedding business of the restaurant.
It has only been established recently that this interpretation was incorrect and the area that was being referred
to was actually an external area of the restaurant that was enclosed post application and approval by Council
in 2009.
This now places the owner, staff and guests who have booked for functions this year in a position where the
restaurant does not have an approval from Council and hence OLGRto be able to conduct events where pre
and post event drinks and canapes can be served.
To date even though the issue relating to the use of the Noosaville foreshore for commercial purposes has
been occurring the owner has never received correspondence or contact from the council regarding the use
of this area of park.
