We are seeking a solution from council that recognises the history of the use on the site and the significant
economic benefits that the weddings and functions contribute to the Noosa region.
The restaurant currently operates under the following approved conditions:
e Trading Hours: 10.00 am to 12.00 am Monday to Sunday Patron Numbers: 120 seated diners within
the restaurant;
The restaurant currently has capacity for 120 seated guests. When a function is held at the property, the
number of guests is limited 120 persons for dining. When a wedding function is being held, the restaurant is
not open to other diners so we may at all times the maximum number of patrons. It is not the intention of
application to provide additional outdoor dining in the permit area or increase the number of patrons
attending the premises.
The total number of guests able to be seated in the restaurant currently is entirely consistent with the
development approval granted (Appendix 4). Consequently, the matter of carparking is not relevant to the
application. This is because there will no increase in patronage to the restaurant caused by the use of the
outdoor area as intended. The applicant is happy to accept conditions of approval in that regard.
The only potential for adverse impacts being caused by the development is with respect to the noise
generated. Currently, there is some piped music operating with the existing restaurant use. There is not music
provided outside other than the music provided by the restaurant use from within. The restaurant provides
fold back doors, making the inside of the restaurant and the outdoor area effectively the one space, for a
limited period.
It is important to note that patrons are encouraged to move inside the restaurant, with the external canal
facing doors for the restaurant being closed by 10pm on weekdays and 11pm on weekends. Further, there no
permanent structures erected in this location. Consequently, any noise generated by patrons is at an end by
10pm each night. The restaurant continues to trade until 12am in accordance with the strict requirements
under the Licence.
