PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 25 MARCH 2014

A plan showing the gazetted send and receive sites is shown below.

Figure 12 – Plan of Send & Receive Sites
(Send sites shown tan, Receive sites shown blue)

As the proposed development footprint is contained within the receive site and no works are to
occur within the send site apart from offset plantings, references to the subject site in the
assessment section of this report can generally be read as referring only to the receive site.

5.3 Transfer of Development Rights Under BDOA Declaration
Statutory Guideline 01/10 Biodiversity Development Offset Area - Koala Conservation states that
the purpose of the associated State Planning Policy includes:

The declaration of a BDOA provides an opportunity to potentially transfer development from one
parcel of land (being the send site) to another parcel of land (being the receive site) in the
interest of biodiversity conservation.

As Sunshine Coast Council advised the State when asked for its views on the Noosa on Weyba
BDOA application, the send sites in this case have minimal development rights. Notionally, the
development rights of the 3 send site allotments consist of 1 dwelling, an information centre and
low intensity rural land uses. The proposed development application for up to 1,008 dwellings
and mixed uses, therefore, does not seek to remain within the confines suggested by the
purpose of the State Planning Policy.

In effect, the development application seeks to benefit from the removal of the SEQ Regional
Plan impediments to urban development on the receive site but proposes development of a
significant intensity, far exceeding that of the send site potential, and which can only be
supported on merit, where sufficient grounds exist to overcome the planning conflicts.
